Restoration of Work Permit

Hi Friends,

I came to Canada as Open Work Permit Status in 2014, when i applied for work permit in my home country as dependent of my spouse who is on student permit in Canada at that time. At that time i got OWP and i came to canada. Recently my work permit was expired.

I and my Spouse both applied for work permits, My spouse applied for Post graduate work permit and i applied for extension of my OWP. Now Immigration department approved PGWP for my spouse but they refused my application with in a week my spouse application was approved. And they are saying as

"As the spouse of a holder of a Post Graduate work permit, you have not provided sufficient evidence to prove that your spouse is employed in an occupation that falls within the National Occupation Classification Skill level of 0, A or B. You may be eligible to re-apply for a work permit if you are able to provide proof that your spouse is a skilled worker in Canada, which may include a letter from your spouse’s employer, stating his/her job title, duties, and salary. If you cannot prove that your spouse is in a skilled occupation, your application for a work permit cannot be approved without a Labour Market Impact Assessment from Employment and Social Development Canada"

Please help me if you have any information about this,
What is the process for applying for Restoration of Work Permit, What are the documents have to submit.

Once your partner is on a PGWP, your partner must have a full time job that is NOC A, B or 0 in order for you to qualify for an open work permit. When you applied for your open work permit extension, you needed to include proof that your spouse has a full time and skilled job.

Does your partner have a full time job that is NOC A, B or 0? If so, you can apply to restore your status back to an open work permit.

Hopefully you have already stopped working. You won't be able to start again until the restoration + open work permit is approved.

I have stopped working from the next day i got refused, from that time i am searching job for my spouse,

My spouse recently got job in bakery, they are saying they will give the job title as "Roti Maker" and pay per hour as $11.25, is this title is sufficient for me to apply work permit or we have to take title as "Baker".

we are confused of this title, please give some advise

I don't know what NOC roti maker would fall under. So I can't tell you if that title would be sufficient.

Baker is a NOC B job. So that would work.

When i met 1 lawyer he raised me a doubt?

That my spouse studied Bio Technology in Canada and technical background, in my spouse education my spouse didn't study in food related courses and now got offer in bakery.

Will Immigration department check what is the education background and job doing now?

I have already completed 45 days now. What is procedure and documents have to submit for Restoration of Work permit?

What is meant by restoration?

You need to apply within 90 days of being refused.

No - it doesn't matter what your spouse studied vs. what job they have now (as long as it's NOC A, B or 0).

I have gone through the CIC website, and found the below form, I have few doubts in this form:
• Application to Change Conditions or Extend Your Stay in Canada (IMM 5710)

In the below options which check boxes I have to select (I am applying for Restoration of work permit)

Question 3: Check the appropriate box or boxes to indicate if you are applying for:
.An extension of a work permit with the same employer
.A work permit with a new employer
.Restoration of your status as a worker
.An initial or an extension of a temporary resident permit

Question 7:In the below they are asking what is the “To date” what date I have to mention there because I don’t have any status now? I am in 90 days period.
From the list, select the appropriate information to indicate your immigration status in Canada:
.Visitor
.Worker
.Student
.Protected Person
.Refugee Claimant
.Other
Provide the dates (From-To) to indicate how long you have had this status

In other question they are asking about the “Details of Intended work in Canada” I am applying as “Open Work Permit” so I have stopped working when i got refusal of extension, Now I don’t have any work offer now. Can I leave the columns empty.

In the Check List they didn’t mention any Form for TRV, do I have to fill TRV form or not?

While i am filling the below form I got one doubt in BACKGROUND INFORMATION Column:

Application to Change Conditions or Extend Your Stay in Canada (IMM 5710)


In the below options which check boxes I have to select


Question 2

Check the box to indicate if you have ever:

1. Have you ever remained beyond the validity of your status, attended school without authorization or worked without authorization in Canada?

Yes or No

If you checked “Yes” to one of the above questions, provide details.


For which questions i have to select YES or NO


Please clear my doubt.

Hey guys!

my work permit restoration is approved in the website, but I didn’t receive a letter in the portal.
should I receive the letter saying that my application was approved in the website? Are they going to send me a document by mail? I need to go back to work and they need this document
