Hello everyone

What are the options after getting visitor status? Can one apply for work permit, with a new employer with LMIA?? Is flagpole an option for the applicant??

Your help and assistance is highly appreciated..

Thanks

Yes - if you have an approved LMIA then you can certainly apply for a closed work permit.

You can apply from within Canada (online or by mail) certainly.

Flag pole really depends on a few more factors.

A) As a rule, you have to be from a visa exempt country - to be able to get a work permit at the border.
B) But if you already had a valid study or work permit and you are entering ONLY from US, you do not need a trv to enter Canada. Since in this case one is visa exempt, he/she can get work permit at the border even if you are not from a visa exempt country. I have done this and know of many others too with similar situation.

However, I don't know for sure if this applies to the situation where some one got a visitor status as restoration (the exact law actually says "lawfully admitted as a worker or student to Canada"). So your situation is a bit different. Those I referred already had valid study / work permits.

At best, I think it is CBSA's discretion and you should at least expect to be grilled over why you got out of status and had to get restoration in the first place.
