Restoration of study permit and post graduate work permit

Hello everyone,

Few days ago, I received a refusal letter on my post graduate work permit. After speaking with staffs at IRCC, I have came to the realization that a big mistake was made on my application. My acceptance notice was uploaded instead of the completion letter, and this was likely the reason for the rejected application.

My study permit expires on November 30th, 2018 and my final grades were updated in August 17th, 2018. The Post Graduate Work Permit application was submitted on October 16th, 2018, and my application was rejected by IRCC nearly 80 days later on January 4th, 2019. Therefore, my study permit had already been expired when the refusal letter was received.

In attempt to avoid becoming an illegal immigrant in Canada, I headed to CBSA on January 8th, 2019 and obtained my visitor visa status. Do I still able to restore my student status and get the pgwp? Can I go back and wait for the pgwp in my country during the processing time?

I believe if you leave while restoration is in progress it is considered that you have abandoned that restoration application.

Also it is 90 days past your graduation date so dont think you can get PGWP at this point according to the rules. You can try your luck by including an explnexplan letter of what happened but its up to the officer. I would also seek all the professional advice you can get start with advisors at your school.

Yeah.. I'm very scared I will get refused again because it is 90 days past my graduation date... what should I include in my explanation letter? Thanks a lot !
You should work with an immigration lawyer. The chances of a PGWP being approved after the 90 days are extremely low.

Certainly you can apply for restoration of SP and work permit together. If you remained genuine student and write an explanations that satisfies visa officer then he can approve your. Restoration and work permit both. I would say better to apply and I believe they will approve it.

now u don't need a valid study permit to apply for PGWP under the new rules, did you apply already.
