Hi

My name is Leonardo and i live in Alberta, i have recently graduated college under my Student Visa. However my passport expired in the beginning of May with my student visa and i made the honest mistake of thinking i would be fine as long as i apply to my work permit as soon my passport arrive.Now i have lost my status as student therefore not being able to apply to my work permit. What is the processes i have to follow to get my work permit and how long would the whole processes take ?
 
So you are under implied status now. The best thing for you to do is apply for Restoration of Status and PGWP. Since you have graduated already so there is no point of extending study permit now. Make a paper application and send it to Vigerville Case Processing Center then wait for the decision average waiting time these days is 60 Days. Timings are important here. When did you graduate? Has your school released your documents yet so you can apply for your PGWP?
Finally, do you have your renewed passport with you now?

You have 90 days from the expiration of your visa to ask for restoration of status, and to apply for PGWP.

No, OP does not have Implied Status. S/he is out of status.

so should i apply for my restoration of status and my PGWP at the same time ?
 
Yes, I am also in the same situation however, I have applied for Study Permit extension 4 days before its expiry, so I am waiting for it. If It is refused then I will do the same thing. Paper application of Restoration status and PGWP as I have Graduated.

Your status will only be restored if you submit complete Documents ie Degree Completion letter, final transcripts etc
 
So i did some research using the information provided from you guys (Thanks a lot !!), and i want to confirm that i am filling the right forms: following checklist IMM5555 for restoration of my status with the IMM5709 form then following the IMM5583 checklist with the IMM5710 form for my PGWP and writing a letter explaining my mistake on letting the visa expire. Therefore paying $200 to restore the visa , $150 to extend the visa, $155 for the PGWP and $100 for the OWP. Please let me know if i am missing anything.

Not Sure about Extending the Visa. If by Visa you mean TRV then TRV can only be extended when you get your new pgwp.
 
There will be no extending of Study Permit. Only Application for PGWP + Restoration of Status.

Incorrect. A valid study permit is required to be eligible for a PGWP, which means that OP needs to apply for Restoration as a student so that he once again has a valid study permit and actually qualifies for a PGWP. A person can't apply for Restoration to a status that they don't qualify for.

Im finishing filling up the forms but i have a couple questions before finalizing it.1) should i sign the pdf after printing or should i just sign electronically? 2)in both forms it ask about my status in Canada, what should i write in them and what dates should i put in ? 3) im sending this by mail, what is the address i should send to ?

1. If the restoration is granted will they issue a study permit or a visitor record?
2. Is an interview required for the restoration?
3. Can I apply for a PGWP after (if) my restoration is granted?

I applied for my study permit restoration since it is required to file a PGWP and I filed a paper application. I haven't heard from CIC. I am worried that my 90 days would pass since I have already received my letter of graduation. Should I apply for the PGWP immediately or wait till my status is restored?

1. If you applied for Restoration as a student, then if approved, that's what your status will be. They won't grant you a visitor record unless you applied for Restoration as a visitor.

2. No.

3. You should have included the PGWP app with the Restoration app. Now you need to wait until the Restoration app is processed and if approved, you can apply for a PGWP.


You have no status, so no, you can't apply for a PGWP now.
