Hi there! My temporary resident status expired on May 15th. I am now evaluation my options, and it seems like the restoration of my status as a worker might be one of the only ones. Based on what I have read here, it seems like there is a chance that I could restore my status and go back to work. I was on a Young Professional visa for 1 year, so I guess my questions are:
Can I apply for a work permit while I apply for the restoration of my status? If so, do I need a new offer of employment from the employer I used to work for?
What are my chances of having my status restored? Is there a better chance that it would get refused?
How long does it take these days for CIC to process a restoration of satus?

Any help would be greatly appreciated!

Thanks!

You can restore your status but only as a visitor. If you want to work again your employer will need to apply for an LMIA and you’ll need to apply for a work permit. That is a 4-6 month process unless you are in very specialized in demand high skilled industries. Restoring status may take a few months.

Thanks for the info. That makes sense. Is the LMIA the only way to get an offer of employment or is there another way? For example, if I am in a pool and I get an invitation for a Young Professional visa or a working holiday visa + an offer from an employer?

Have you confirmed that you qualify for another participation in the IEC program? Do you know if your country allows multiple participations?

Being in the pool and receiving an invitation for a Young Professional Visa or Working Holiday Visa is not enoungh to start working again. You would need to have the actual work permit approved and issued before you can start working agian.

You should also be aware that IEC programs have been paused due to COVID-19 and invitations aren't being issued at this time. So while this may be an option at some point in the future, it's not an option now.

Thanks! I do qualify for another participation in the IEC program, as my country allows 2 participations. I guess it won't matter now for some time anyway.
So if I want to restore my status, I need to fill up form IMM5710e, correct? And I need to check where it says RESTORE MY STATUS AS A WORKER? There are 3 other boxes, but i'm not sure about the one that says "get a new temporary resident permit (for inadmissible applicants only"?
Is there any other form that needs to be filled up? Thanks again

No, not correct. You don't qualify for a work permit. You need to apply for Restoration as a visitor.

As said previously, you need to restore your status to visitor. It is not possible for you to restore your status to worker.

Once the IEC program re-opens, you can submit a profile and hope to be selected again.

Instead of applying to restore my status as a visitor, can't I just apply to get a visitor record? Isn't there a better chance of not having this one refused and allow me to stay longer?

No, you can't. You're out of status so this is not possible.

You need to apply to restore your status. There's no way to avoid the restoration application.

I suggest you do some more research. Applying for Restoration as a visitor IS applying for a Visitor Record. If Restoration is approved, you will be issued a VR. You can't just apply for the VR. Only people with status can do that.

Sorry, but are you able to confirm that the form I need to fill up is IMM5710e and choose "restore my status as a worker" ? It's a bit confusing.

thanks again

No. AGAIN, you don't qualify for Restoration as a worker. You need to be submitting a visitor app.
