Restoration of status!

Hi everyone! hope you can help me.. So, here is the situation... MY friend applied for a restortion of status last Oct. 2010.. She clicked on The box D.. Restoration of status as visitor, worker, and student... Now, she received a refusal letter... In the refusal letter it states there that she should pay 350.. and they can't process the application anymore... It also state there that she can't apply for another restoration as she is past 90 days restoration period... We want to know what is the 150 all about.. She paid 200 because the restoration fee is 200 only.. pls. give us advice on what to do.. :mad:

The $150 was for the cost of the work permit, which is in addition to the restoration. She now has to leave.

HI! Thanks for the reply... the thing is she applied for restoration as a visitor.. does she still need to pay 150... They send all the documents back to her... :(

Then it would have been $275.

Hi there,

Luckily I had found this forum when I was so confused. If there anyone in this room can help me out? I would be very much appreciated. I was so wondering whether of my status need a visa extension or restoration. I landed here with a tourist visa for permission of staying 6 months since last Sept 2010. Before it expired 2 months, I had applied for an extension for another 3 months (mailed to Vegreville AB so I have a copy of receipt paid in Financial Institution and Canada post receipt of delivery). My visa expired at the end of March 2011 (I have now over stay for about 2 months). From then, I still have not heard from CIC officer so my question are:

1. Is that possible for me to apply another extension (3 or 6 months)? As my above explanation, I actually applied for the extension follow the time allowed but nobody replied me so I don't know what happened? I had married a Canadian and my husband is gathering his legally documents to sponsor me next month. I would like to stay here and wait for the result of the sponsorship, so how long do you think it would take?
2. If extension is not possible, then would a restoration be a chance?

Please help me to clear the above issues

hi guys, I applied for restoration March 3, 2011, my visitor visa is valid six months from August 18, 2010 to which I arrived here at canada..I also applied for working permit at the same time but different offices ; Vegreville - for restoration & Buffalo for work permit..I just recently a refusal letter for my work permit...Should I wait for my restoration status before reapplying my work permit? My LMO expires on August 18 2011. Am I in so called implied status until the approval of restoration?

I think you are called implied status as long as you applied for your restoration of visa in 90 days before your visa expired. All you need is keep your record to prove that you stay in legal application such as postal receipt and invoice of the service paid. In addition, as showing on the CIC website the working process for visitor visa is now 165 days so I think you still have time.

Thank you for your reply.

I apply for restoration 20 days AFTER my status has been lost. This is what was written in CIC with regard to restoration of status and
I quote:

"You may seek restoration within 90 days after your status as a visitor, student or worker has been lost, if you
have only failed to comply with one or more of the following conditions:
• You lost status because you remained in Canada longer than the period authorized for your
stay (but not longer than 90 days)
• You changed employers, type of work, or location of work without applying to change
these conditions if they were specified on your visitor record. (Applicable to those
workers not requiring a work permit).
• You changed the type of studies, educational institution, location of studies, or times and
periods of studies without applying to change these conditions on your study permit if they
were specified on your study permit
• You continue to meet the initial requirements for your stay and have not failed to comply
with any other conditions imposed.

What if my LMO expires before they start the processing of my application?
Thus my denied work permit have affected my restoration application?
