Restoration of status

Please, I am a canadian, was working in Nigeria and my wife got pregnant. So we came to Canada for her to deliver our baby. She is on a TRV and it has expired, and she have to go for an interview in Ghana for her PR. Will the immigration let her back in if she apply for restoration before leaving for Ghana? What can we do in this kind of situation? First of all, we applied for an extension before her visa got expired, but it took more than two months for the immigration to get back to us. And they refused her extension because we did upload her TRV which they never asked for. She came to Canada in july 16th 2010 and her six months was supposed to be Jan 16th 2011 but the immigration stated that the TRV expired Mar 02 2011 this information was given to us Mar 03 2011. She is breast feeding and our baby is just six months old. We don't know what to do, if she will go for this interview and apply for another visa in Nigeria. Please help us out on this issue.

Restoration won't do her any good. She would require a new TRV to enter Canada and that has to be obtained overseas.

1. Why apply for the restoration if she is leaving Canada.
2. If she doesn't attend the interview, it will probably result in a refusal.

Just worrying if they will give her a new visa on time and not delay her in Nigeria, she will be traveling with our baby(a citizen).

Please do u know if my wife travel for her PR interview if she will be granted a new TRV outside canada with sufficient documents show our daughter is a born canadian and also she is married to a canadian with reasonable reasons that she tried to apply for an extension but it was refuse due to insufficient documents (but they didn't ask for it, her proof of entry) or will she be delayed or denied entry. Our daughter still have to go for her vaccination injection. Please someone should help me out. So much appreciate for this discussion forum

There are no guarantees.The reason no one is responding is because immigration is a law unto themselves. If it is important for her to attend the interview then by all means she should go back to Nigeria. And if it is an interview for the sponsorship then pray it is good news. Immigration officers are humans too and they know how difficult it is to be apart from family, and so when she applies for a TRV to come back to Canada, appeal to the officer processing her application (thru a letter; may or may not help but hey, think positively). Attach all the documents you have (how you tried to extend her stay to be able to stay legally, and how the non submission of some docs led to the refusal (as per their response)). It may be that she will not need to apply for a TRV and might get approved for the Permanent Residency. Hope everything works out for you and your family.
