Hi,
I came with my husband in sep 2012 as an accompanying spouse because he was on a study permit. My visa expired on Mar 2013 but i had gotten a work permit till Dec 2013 so i could stay in canada. My husband has a PGWP till Nov 2014 and is currently working with one of the banks. We had our baby daughter during this time as well in Sep 2013. I applied for an extension of work permit but got refused. Cic says

"Your application as requested is refused.
After considering all the circumstances of your case, it has been determined that you are not a
person whose employment will create or maintain significant employment, benefits or
opportunities for Canadian citizens or permanent residents.
You have not provided sufficient evidence to prove that your spouse is employed in an
occupation that falls within the National Occupation Classification Skill level of 0, A or B. You
may be eligible to re-apply for a work permit if you are able to provide proof that your spouse is
a skilled worker in Canada, which may include a letter from your spouse’s employer, stating
his/her job title, duties, and salary. If you cannot prove that your spouse is in a skilled
occupation, your application for a work permit cannot be approved without a Labor Market
Opinion from Employment and Social Development Canada
We also wish to advise you that your temporary resident status expires on December 31st, 2013.
You may apply for restoration and for an extension of your stay in Canada as a visitor
if, within 90 days from the expiry of your temporary resident status you submit:"

Now i need to know whether i should apply for a restoration as a visitor like they say or should i apply for the work permit along with restoration. I am very confused. My husband has status till Nov 2014 and he's also working in a proper full time permanent job. Please can anyone guide me here on what to do. Also what is the processing time for restoration of status because i couldnt find it on the website.
I would highly appreciate any advice. I dont want to be illegal status but cic replied to me on Dec 22, and i couldnt just leave in 4 days with all the Christmas and New Year vacations around. I applied on the 2nd of December so that my timelines are not affected for application, but i dont know any more what to do. Kindly advise.
Thanks in advance.

You can apply for your restoration and work permit at the same time and this application can be submitted on line. Online is faster than the paper application. However, this time you should provide as many documents as you can proving that your husband is a skilled worker. If was here on a PGWP, then you should also provide his post grad education related documents e.g. degree etc. The job description for the position that he was hired for on a company letter head would be a good document to present. Also the employment letter stating the position and the salary for your husband should be provided along with.

The time line for restoration varies a lot. It could be anything between 2 months to 4 months. For me it took approximately 3 months.
