Restoration of status as a student

I have a open after graduation work permit which expires in May. We have applied for PR under the CEC in August 2012. my husband status expired on Oct 2. his extension for a work permit was refused on the bases that i am working and no longer a student and that CIC no longer give open work permit to spouse of after graduation permit holders without an LMO. So we decided to apply for the restoration of status as a student in the 28 Nov. online. His 90 day ended Jan 5th, it is now March 11 we have not received a response. I have been trying to call but have not gotten through. Now I am thinking it is too late for the student visa.
1. what should we do?
2 Can we change this to a visitor application now?
3. How would this affect our PR application?

He can only restore as student if he has previously been a student and has registered to return to scholl as full-time student.
