residency obligation with renewed pr card

Dear pmm

suppose if a person is granted pr in dec-2002 and will expire in dec-2007.
after dec-2007 when his card expires he is out side canada .he apply for a trv to go back canada and apply for a renewed pr card.

the visa officer grants temporary resident visa and declare that he has passed residency obligation of two years out of five. then that person goes back canada and got his pr card renewed and then came back his home country .please explain wheather this person now can spend three out of five years in his renewed 5 year period or he will lose his pr card . the expiry date of his renewed pr card is 2012. if

1. It is a rolling 5 year period.
2. So lets say the person had been out of Canada for 2 years and then returned, stayed for 3 months and got a new PR card in 2009. They would only then be able to stay outside Canada for 15 months. If it was longer than 15 months when they re-entered the next time , the officer would look back see that they would be unable to reside for 2 years in the 5 year period from 2007 to 2012. They then would be reported.

now i tell you my situation in detail
I was granted first Pr card on 15-12-2002 for up to 15-12-2007
Then in Dec-2007 after applying for renewal i had to come back my home country.so i was without pr card.
frome canadian embassy of my home country i applied for a TRavel document
the visa officer checked my passports and every thing and he found that i have accumulated 830 ( in different parts) days out of 5 year period (15-12-2002 TO 15-12-2007)
Hence visa officer declared that i have mer residency test and grant me a R-1 visa valid for six months on March-2008
I went canada on 27-april 2008 and got my pr card which was renewed.
i lived in canada upto 15-12 2008 and the came back my home country
Now since 15-12-2008 i am in my home country and planing to go back canada on 20-06-2009.My new Pr card expiry date is 15-12-2012,

1. please explain in this way if i am maintaining my residency obligation or i have lost it.
2.when i will appear on 20-06-2009 at port of entry weather i will be fine or in trouble.

You have to do the math. From 20/06/09 go back 5 years to 20/06/04. Between those 2 dates you have to have resided in Canada for 730 days (2 years). If you have fine, if you haven't, you have a problem.

As far as my knowledge is concern, you have already completed the obligation in first five years by leaving two years 730 days, now in next five years you have to spend at least minimum 1 and half years to meet canadian cisitzenship,

please corret me if i am wrong

PR residency obligations have nothing to do with citizenship. For PR residency obligations, he needs to have been in Canada 730 days in the previous 5 years. If he is coming back to Canada on June 20th, they will count back 5 years from that date. He doesn't say how much time he spent in Canada from 20/6/04 to 27/4/08. He does say he spent from 27/4/08 to 15/12/08 in Canada so that is 232 days. If he had another 498 days stay between 20/6/04 and 27/4/08, he's ok.

To apply for citizenship, you need to have been in Canada at least 3 years in the previous 4 years. It's not enough that he's lived in Canada for 3 years total in bits and pieces over the last 7 years. Has to be over the last 4 years.
