Resettlement in Canada

Hello I'm a Congolese from Drc refugees in South Africa married to a South African citizen we have two kids together conditions of human rights are not respected our refugees status allows us to work and study but most the case can't job's with it. Every time when citizens want support from government will March against foreigners I got tree warning from unknown citizens claiming that we come to take their wives and jobs In my country Congo we are tired of wars and government killing Now my question is if want to apply for resettlement in Canada will they consider me with my wife and kids? Please help

You have two options for applying for refugee status in Canada. The first is to be officially declared as a refugee by UNHCR or the government of the country where you are living - and then to be selected for resettlement in Canada. Note that you cannot decide where you are resettled. Either UNHCR or the government of the country where you are living now would have to select you for resettlment in Canada.

The other option would be to obtain TRVs (visitor visas) to Canada, travel to Canada and claim refugee status when you arrive here

Okay what about my wife and kids they are southafrican citizen can they travel with me and claim refugees

Curiosity question. Since you have married somebody from South Africa, how come you did not ask to change your stay permit based on that marriage?
Most countries do have special permit for spouses.

Second thing, what will be your chances to succeed refugee claim against your home country if you are already living for some time in a different country where you seems to have ties now (wife and kids).
You can surely try TRV but even if you get visa, your chances are low due to your life in South Africa.
A claim, that some locals are sending you home, are way not enough.
What did you do in that case? Did you contact local police to investigate? Did you try to move to a more foreigner friendly parts of the country?
Just for your information. if your claim is failed, then you will not be sent back to South Africa (your wife and kids will but not you). You will be sent back to your home country. With almost no chance to get visa to any western parts of the world in the future.

Best advice, first try to check what are the possibilities for economic immigration and if you can fit in any category.
In addition investigate how to deal with your status in South Africa since you are already married.

Our families are been discriminated and not allow to visit us in Canada and we can stop that.

I have a federal petition opened on our parliament to put an stop to this practice. We should have the right to invite our family to visit us.

Your family is not being discriminated against. You already have the right to invite your family to visit, as evidenced by the fact that you have done so. However, they do not have the right to come to Canada.

As for your petition, people can and do lie on invitation letters all the time, so it would be nonsensical for IRCC to consider these letters to be absolute truth. The conditions of a person's country must be considered, as historically, those with decreased conditions of living are much more likely to stay illegally or submit a refugee claim; you can blame all of the people from your country who have done this instead of blaming IRCC. There is no legally enforceable way to make someone pay for all expenses of someone that they invited; you could submit a notarized declaration stating such but it still cannot be enforced. There is also no point in having both parties sign an agreement that the visitor will leave because as said above, people can and do lie; someone desperate to get to Canada will sign anything, just as someone desperate to have their family come to Canada would sign anything. Every person who enters Canada essentially makes such an agreement with the government of Canada anyways and every person that overstays breaks that agreement.
