Dear Leon and others (who are in trouble) on the forum
thank you Leon and all others on the forum!

It is brought to your notice that as I was waiting for the interview call and was much upset due to the scary steps CIC is taking every other day against those at fault but in today's mail I received a letter from CIC that exactly says:

" This is to confirm receipt of your request to withdraw your application for the renewal of your PR card. Your application has been withdrawn and your file is now closed".
They have further written that if you fulfill the above mentioned residency requirements (they have mentioned subsection 28(2) of IRPA in the beginning paragraph) and want to reapply, you can apply with new forms, fees and photos. Your application has been sent to Sydney Nova Scotia for retention.

I am completing 730 days on July 06, 2012. so I will apply for renewal soon.

Those who are new on the forum and have made mistake like me i.e. applied before fulfilling residency obligation (unknowingly), please do no wait for a next moment and apply for withdrawal. I joined this forum in Feb. 2012. you can go through my posts. I spent very very hard time rather it was torturous.

1. I came back in July 2010 (stayed out of Canada 4/5 years)

2. applied for renewal in Aug.2010

3. when realized that I have made a mistake by applying for renewal without meeting 730 days ......I applied for withdrawal in Jan 2011 but unfortunately time mismatched, the day my w/d application reached CPC, my PR-case reached St. Clairs office Toronto.

4. in Feb 2012 I received RQ from Scarborough office. I requested for 3 weeks extension in deadline to submit RQ and in the same application I requested for withdrawal also, if possible. They replied and gave me much more extension up to April 30, 2012 but did not talk about withdrawal.

5. I hired a lawyer to fill up few parts of the RQ. he sent my case on my behalf on April 12. The lawyer seemed gentleman and he might be but I was not satisfied........I have already mentioned his intentions. he submitted my incomplete papers (H&C ground proofs) and incomplete RQ and he wanted me to pull to appeal.....

6. I left that Lawyer and wrote to CIC Scarborough too and again requested for one month extension.

7. I prepared my case again with each and every proof of H&C reasons and proof of my almost 2 year stay in Canada

(2 daughters' school record, a daughters' university record, debit/credit history of banks and credit cards, proof of property purchased, mortgage and many other things etc) and submitted on May 20, 2012 with in-detail covering letter.

I am writing all these to make you know that what could be possible and what not.

Leon the letter I have received today is interesting in a way that:

a. on the top address of St. Clairs office is written

b. at the end after the signature of official, it is written

PRC investigations
Citizen and immigration officer
PRCDC-GTA-CIC Scarborough

and lastly to tell you that the date on the letter I have read few min. ago is April 02 2012. So this decision was made 3 months before and I remained in torture throughout this period. I wish everything goes smooth now onward....
what do you think, am I safe now?

Yes, if they accepted your withdrawal, you are safe now. Once you meet the residency requirements, you can apply again and they will consider the 5 year period prior to the date of the new application.

Hi janay,

I have a question,
Did they return your PR card ? I think in order to reapply you need to send them your PR card.
I would appreciate if you let me know about this issue.

hi. when I applied in Aug.2012 I did not send PR cards. Now I will apply in a couple of months but will not send the old ones as is written in the new rule, we have to destroy them.

Hi Janay, so actually you are saying that your letter with all the proof has been sent after they decided to withdraw and forget your application. Correct?
Usually the days are considered since you have landed in Canada until the application is sent and they look at the last 5 years from the date you sent the application.
I did your same mistake (I discover this post too late) and I recently withdraw my application without answering incomplete RQ and incomplete H&C grounds letter.
I really hope I'll be lucky like you, because I think that they are so full of things to do, that sometimes they just leave it.
