• “Educational credential” is defined in R73 as any diploma, degree or trade or apprenticeship
credential issued on the completion of a program of study or training at an educational or
training institution recognized by the authorities responsible for registering, accrediting,
supervising and regulating such institutions in the country of issue.
• “Full-time” is defined in R78(1) as requiring at least 15 hours of instruction per week during
the academic year, including any period of training in the workplace that forms part of the
course of study.
• “Full-time equivalent” means, in respect of part-time or accelerated studies, the period of time
that would have been required to complete those studies on a full-time basis.

I have questions here
Question1. What is meaning of “apprenticeship credential issued on the completion of a program of study or training at an educational or training institution recognized by the authorities responsible for registering”?

I am giving here one example of apprenticeship as per my knowledge. Please correct if I am wrong. Example: Suppose one person has completed his Bachelor degree from one college and have total 16 Years full time education (Grade 12 + 4 Years Engineering). Now if
a) He joins same college or other as Lecture to teach students (for one year) some time (like One year) and parallel, he goes under training; will be cover here as apprenticeship?
b) One Engineer will join one Industry (for one year) as Training Engineer and will go under different kind of trainings. Will this means this person has one year apprenticeship and now he has 16+ 1 = 17 year’s total education.
Normally working time is 8 -9 hours/day in both cases. Working day: Monday to Saturday

Please let me your valuable suggestion.

I think it means that an apprenticeship that is part of a program of study is considered as a educational creditional for which you could claim education points.

You have to consider whether the training in both cases is part of any educational or training instution that is considered as such in your country.
a) What kind of training was it? Was it training at a college or university as part of some educational credential or was it training for work without any credential. If its the later, then this wont count towards education points.
b) In this case, was the engineer given a formal credential issued by an educational or training institute in your country? or was the engineering just promoted in the company. If its the former, it might count but not if its the later.

I guess you are asking this so that you can claim 25 points. If yes, then remember its not just 17 years of education. You also need a masters and PhD to go along with that 17 years of education. If not, then you can only claim for your bachelors.

Remember, I am no expert so my answers might be wrong.

Thank you for speedily reply. Plz have a look on my profile and other details.

I applied my Canada PR to CIC, Buffalo Office (from Toronto) on Oct, 2007 and then after I received CIC letter regarding Language Proficiency Test. I appeared on IELTS- General (English) Exam from Hyderabad itself and scored less marks, required for smooth processing of my application. I sent that my IELTS result to Buffalo office and then after few weeks, I received another letter to say that they had calculated my total points and had taken decision to close my PR application, (because of few lesser points -sort by 3 points). I requested them to reopen my application and give me another chance, so that I can re-submit some additional documents (such as another IELTS exam, current Work experience letter) to support my application. However they didn't consider my request and suggested me to apply again when I have sufficient points.

After then I found that CIC has changed Immigration RULES such as structure of IELTS numbers (Sometime in JULY-AUG, 2008) for SKILLED workers category. I again reappeared on IELTS exam on Sep, 2008 and scored more marks. As per new rules, now I am eligible to apply my application once again. Currently I have 68 points after calculating new IELTS results + Work exp + others.

Currently I am in India. You know, Immigration processing time is very high (62 -72 Months) in India as compared to Canada (13-19 Months). So in safer side and fast processing side, if I could come to Canada on Work permit in near future then I will again become eligible to re- apply under new RULE. This new rule will take less time, will final my application status within 6- 7 Months. I appeared in new IELST on Sep, 2008 means I have to apply this new application before Sep, 2009(CIC takes only year IELTS result) and to fulfill this rule ‘worked full-time temporarily in Canada within the last three years ‘condition under new rule. Moreover, I have started FRENCH class in India, so that I can appear in TEF exam and score some points from French exam too.

My profile details are.

Education: Bachelor Degree in Engg. (16 years of full time study) -> 20 Points
Ability in English: IELTS (L -> 2, R-> 4, W-> 2, S- 4 = 12 ) -> 12 points
Experience: More than 5 years of IT experience -> 21 points
Age: 29 Years -> 10 points
Arranged Employment -> 0 point
Adaptability: Principal Applicant or Spouse / Common-Law Partner has
worked in Canada Worked full-time in Canada for at least one year.
I was in Toronto on Work permit for 1.1 Years (Oct, 2006 to Nov, 2007) -> 5 points

My queries are:
1. I would like to know, does it possible to re-open my old application that I submitted at Buffalo Office (Submitted on Oct, 2007) and would like to claim new IELTS points on that same Oct, 2007 Application? If yes, then how can I do it?
2. Is it possible to HIRE immigration LAYWER from Canada itself and submit a request application to CIC for re-opening of my old application?
3. How will CIC, Buffalo Office treat my new application? Does reapplication work or not?
4. What could be possible chances and verification durations, if I go to Canada on WP again and re apply from there? I have an understanding that CIC already verified my application, so new application might not take more time.

I have one doubts that as per link http://www.cic.gc.ca/english/information/applications/skilled.asp
There are three categories under the Federal Skilled Worker Class:
• Category 1: For persons in an occupation which corresponds to the list of occupations identified in the Ministerial Instructions and have evidence of one year of continuous full-time (or full-time equivalent) experience in that occupation;
• Category 2: For persons who have arranged employment offer with a Canadian employer; or
• Category 3: For students or workers who are legally residing in Canada, and have done so for at least 12 months immediately before submitting their application.

As per you reply that I will come either Category 2 or 3. I already mentioned that I was in Canada during Oct, 2006 to Nov, 2007, so if I will come to Canada on WP and wish to again re-apply a new fresh application.
1. Do I have to wait for completion of 12 months before applying a new application??
(Category 3 line)
2. Or CIC will consider my 13 months (Oct, 2006 to Nov, 2007) stay and give me a chance to submit it

I have no idea to question 1 and 2
Question 3 - you can reapply if you have gotten rid of the reason for your initial denial. From your message, it sounds like you have 68 points, so you should apply again.
Do you mean verification as in security checks and stuff, if thats what you mean, they will do security checks again.


For category 3, you have to be in canada and have been there for 12 months IMMEDIATELY prior to application. you'd have to wait 12 months before applying under category 3.

If you have a job offer then you can apply under category 2. For this, you don't have to wait 12 months.

Remember it was under the old rules that Delhi CHC took a long time. WIth the new rules, that should get cut down. We don't know by how much.

I hope, you are now very much clear about my profile and my past application procedure etc. I would request you to plz let me know what is BEST, Convenient and Feasible way to apply my new application for Canada PR that will take less time (less than year)
1. From Canada it self
2. From Delhi itself.

If I would apply from DELHI then what could be possible situations in my case to apply for new application. Ex: I have to wait for another 12 months or I can directly apply here in Delhi…Do you any idea now, what is normal immigration processing time in India (under NEW rule)?

Regarding Verification means CIC already verified my documents such as school/college certificates and other submitted documents on my old application. If I would submit fresh new application in Canada or Delhi, I am assuming that now time this verification process might take LESS time. Can I refer or link my new application to old/closed one???

Also request you to plz clarify this line “Question 3 - you can reapply if you have gotten rid of the reason for your initial denial. ?? What is meaning of rid????
