Hello!
We received a request to fill out IMM 5409 - Statutory Declaration of Common-law Union. On the form it asks to declare that we have cohabited in a conjugal relationship for number of continuous years from date to date. We have two periods where we lived together from June 10, 2014 to September 29, 2015. Then we lived separately in our own countries for 3 months. We then lived together again from January 17, 2016 to Present. We were wondering if anyone has any idea how we should fill out the form with 2 separate dates? Any guidance would be great, we have no idea what to do. Thanks so much!

Hi there,

When you were apart for 3 months, did you completely move out with all your stuff ? Or you were just apart knowing you were coming back ? And also, you were apart for a particular reason ? (No need to explain why here :) )

If so, I would take it as you were together since the first date you mention. It´s always full years to have to count hough, so if it´s a year and a half you have to write 1 (one ) year.

Honestly I personally would the time period in which you have the most proofs of your relationship, but feel that the most recent would be more viable, because it is still ongoing. Later on it requests proof of your relationship as well, and you can also submit proofs from both times you have lived together anyway.

There is another portion where it will ask "Is there any other information you wish to provide about your relationship," and you can write out a letter about both times you have lived together, and why there was a 3 month gap where you didn't live together.

Either way you have hit your 1 year common law mark. You just have to provide the proof for the time you are declaring in your Common-Law Declaration. So as said before, use the dates that you have most proof for.
