Hi all,

I had recently mail the sponorship package to CIC Case Processing Centre (forms and all supporting documents) for my wife. My wife is staying with me in Canada on a visitor Visa until April 8, 2012. We had applied for extension for 6 months before and we would like to make another request to stay in Canada during the process. Is this possible? Would CIC reject the request?

To make matter worse, we are planning to go to Hong Kong (my wife is from HK) for wedding reception (we got married in Canada last year but most of my wife's relatives are in HK) in the month of April.
We will come back to Canada in May. Would she be turn away by the official in the airport? What's the likelyhood? Also, say if she could return back to Canada, do we need to request for extension in the first place (refer back to my first question)? I know many visitors are granted 3 to 6 months to saty in Canada.

Any opinion wold be appreciated.

Hi, sending the application for visitor visa is not only possible, it is required! Yes, you can and should send the request to prolong her visitor status as soon as you can! If it expires in 8 April, better to send it a month in advance! So tomorrow is perfect! I sent my application via internet and got a quick response.

They do not recommend to leave Canada whilst your inland application is in process, as anything can happen! Noone gives any guarantees in regards re-entry on visitor visa! However, people are taking chances and are successful! The main idea is to prove ties to homeland when entering Canada.

Thanks Am_lina. Just to clarify, we filed as outland application instead of inland. I will get the request fo extension ready ASAP.

:) good to know! Well, at any case, if she wants to re-enter Canada, she will need a valid visa. What you are going to get from CIC is called visitor's recors, as far as I know, it does not allow re-entry, it is just a legal paper showing your legal status! But on the basis of that visitor's record you can apply for visa in Canada or being in China! If I were you, I would obtain visitor's record from here, and when in China send it all for visa. Don't overstay and all will be fine. I hope everything goes well for both of you, and you have great celebration in China! Good luck

Acutally Hong Kong is visa exempted so she doesn't need to apply for visa. She came to Canada twice (both times were visiting) and didn't get questioned too much. So when I apply for extension, should I enclosed the receipt number (IMM5401) from the application to proof that I had submitted and paid it? As for the reason to stay, should I put she wants to stay during the application was being process?

::) ooops, sorry, I did not know it is visa exempt country! That is even easier then. Go online and apply to extend status in Canada; yes, in the reason section write that your wife wants to visit you while application for PR is being processed ( I did so ). If you do it online, you pay in the end of application, so you can print it out. I think it will be processed quick and you get your visitor's statur really soon! If you have it when coming back, I think it will be enough to show it in the airport, if no, then have your reciept just in case!

If you mean to enclose the reciept from your PR application, I don't think it is required if you apply online! As far as I remember I attached my passport scan and bank statement as a proof of funds. If you are going to send via mail then you can attach it! But as far as I know they only need to know your client I'd (which your wife has in previous extension). They will find your pr application by that numbver.

If you leave the country and especially in the case of a visa exempt country and seeking to re-enter, applying for an extension to your stay in Canada doesn't seem to make a lot of sense.

When seeking to re-enter after departing the decision will be based on whether you are admissible at the time of re-entry and the officer making the decision will need to be satisfied that you are a genuine visitor at the time notwithstanding that you have applied for sponsorship. If the officer believes that you will depart if required at the end of the visit allowed, considering that the sponsorship could be rejected, then it is possible to approve entry as a visitor. At that time the officer could issue a visitor record in excess of 6 months which, as you may be aware, is the usual time provided for a visit if not altered at the time of entry - longer or shorter.

If your spouse is planning to stay without the planned trip you must ensure that you keep in status and apply for the extension; if you absolutely will leave before status ends during this stay then the extension is not necessary, but neither is guaranteed re-entry.

You will need to decide what is best in your circumstances and belief of which is most likely to be successful for you.

Best of all for success whichever way you proceed.
