Hi there,
I am new to this and wanted to get some advice.
My wife sponsor me inland in Canada and i am from the UK but a German citizen
we started our sponsorship in 2013 November and in june 2016 i became a permanent residence.
our marriage had it tolls and she has changed a lot ever since, she didn't get along with my family very well in the uk and we had our issues.
she didnt work or have a job but when i received my open work permit i have been working ever since for the past 2,5 years until now.
i put up with a lot of stuff and always believed she will get better but when my family decided to come for a wedding she was not to happy as she did not want me to spend so much time with my family. she is insecure controlling and was emotionally manipulating me.
i put my foot down in seeing my family and taking them out etc here in canada, and she didn't like it this happen in july 2016 and that when she told me that i chose my family over her and her daughter which is my step daughter. and that she did not want to be with me anymore.
I had to get a lawyer which was useless and wasted my money. my wife then told me she will get me deported and i will have to go back to the uk?
she called cic and told them i used her to get my pr.
i then contacted cic and explained and they told me if my safety is at risk to leave and find my own place.
from july to November 2016 i was living with her in the same place that we got shared a car etc.
i was in our room and she went into her daughters room. she made my life hell i felt like i was in a prison.she called the police on me multi[ple times for piety stuff and the police never did anything.
eventually she took the locks away of my bedroom door and i called the police and i was worried. the police advised me i should maybe stay at a relative house until i move into my own place. i packed my stuff the same night and left and secured a place from November 1st.
my lawyer told me that i have to request and do it on my own for the condition 51 to be waived on my pr. which was on going from december 2016. after sending all the evidence i had which was not a lot but cic asked me to show pictures of us that i was together with her since i became a resident in canada.
they send me then this":
[b]Dear xxxxxxx:
This refers to your request for an exception from the condition that was imposed on you when you became a permanent resident. The condition set out in the Immigration and Refugee Protection Regulations (IRPR) section 72.1(1) requires that you cohabit in a conjugal relationship with your sponsor for a continuous period of two years after the day on which you became a permanent resident.
You requested an exception to the condition under section 72.1(6) of the Immigration and Refugee Protection Regulations which sets out:
· the condition in IRPR 72.1(1) ceases to apply if an officer determines, based on evidence provided by the permanent resident or on any other relevant evidence, that
o (a) the permanent resident
§ (i) is not able to meet the condition throughout the two-year period because they or a child of theirs or the sponsor, or a person who is related to the permanent resident or the sponsor and who is habitually residing in their household, is subjected by the sponsor to any abuse or neglect referred to in the IRPR 72.1(7) during that period, and
§ (ii) continued to cohabit in a conjugal relationship with the sponsor during that period until the cohabitation ceased as a result of the abuse or neglect;
The assessment of your request for an exception under IRPR section 72.1(6)] has been completed. After careful and thorough consideration of your request and the supporting information and documents you provided, it has been determined that an exception to the condition does not apply in your case. As a result, your request for an exception to the condition has been denied.
Please note that on October 29, 2016, the Government of Canada pre-published in the Canada Gazette new regulations regarding the repeal of the conditional permanent residence which should come into force in the Spring of 2017.
