Rentry into Canada as PR

Hello Friends, I completed my PR on 3rd Dec 2014, after that, I stayed only for 2 weeks inside Canada, and then left for my Home Country, now in March 2018, i have the plan to return permanently to Canada.

My question is if inside Canada for 2 consecutive years, will I be eligible for PR renewal? Also, should I expect any problem at the port of entry due to my long stay outside Canada?

By march 2018 you will have missed meeting RO and it is possible that CBSA will report you at entry. If they don't, you should be ok after 2 years ( make sure you have 2 years as an absolute minimum...the more time the better before renewal).

As you would no longer meet the Residency Obligation in March 2018, yes, you should expect problems at the border. There is definitely the possibility of being reported for not meeting the RO, which begins proceedings to revoke your PR status. If you are able to enter without being reported, then you can stay 2 years to once again meet the RO.

You should return to Canada before the end of this year while you still meet the RO if you want to be sure you will keep your PR status.

It's wise that your coming here for advice before violating your RO. March 2018 is a no go. You gotta arrive in Canada before 3 December 2017 if you don't want issues. (issues being possible loss of your PR status.)

RO = Residency Obligation.

You need to be inside Canada 2 years in a 5 years period. So once you are outside Canada more than 3 straight years, you can no longer physically meet the 2 in 5 years requirement which is a violation of the RO.

If you left Canada Dec 17, 2014, you will be in violation of the RO starting Dec 17, 2017. So if you return anytime after that date, you risk being reported upon entry and having your PR status revoked.

That means you won't be in violation of RO until Dec 2018. So returning in March 2018 would be fine.

My suggestion is that if you have a valid PR card then fly directly to Canada and use the automated border entry option and that would give you a slip of your declaration copy and hand it over to the CBSA officer and exit. This is I think you can avoid questions about when you were away etc.

But won't the CBSA agent check the slip and see that you have not satisfied the RO? Of course, I guess it's also possible the CBSA agent might not even notice and simply let you through?

The slip only says you were out of Canada for more than 7 days not the exact date. The declaration card is removed and it is instead at the kiosk you enter most of the things that was once part of the declaration card. So it is my guess that if you use automated border option then you will not be asked when did you leave Canada etc.

FYI there is still a possibility of going to secondary inspection (which would cause any RO violation to be discovered), even if using the automated kiosk for immigration. It may randomly select people or maybe there is some criteria that is flagged, who knows. The majority of people though do go through quickly and with no other questions.

I know there are certain CBSA officers in Vancouver that wait at the end of the automated process and review your slip and those particular ones always ask how long I was away and why. So it's always a gamble.

Dear Seniors,

I have a question. If I land in May 2017, I understand that the latest I need to come back to Canada is May 2020. I decide to come back in Nov 2019, which let me have around half year buffer time to get in and out Canada in the rolling 5 years before I renew my PR. I understand that would be fine and officer will let me in without any trouble. But will I have any problem between May 2020 to May 2022 if I go in and out Canada (using the half year buffer time)? How do the officer know I am meeting my RO? Do i need to carry some proof of documents everytime I get in Canada again within that 2 years?

Besides, If i come back in Nov 2019, when can be earliest I can renew my PR card? Or would it be wiser if i wait till completing 3 years straight and apply for citizenship?
