Renewing Canada Permanent resident card on Compassionate grounds

Hi All,

Greetings.

I was 2 years old when my father secured Permanent Resident status to Canada. We had been to Toronto and have my Social Insurance card and my Permanent Resident card issued in 2007.

My father took decision to return to India and we have not been to Canada since then. I am now 18 years old and wish to renew / reactivate my Permanent Resident card issued in 2007.

It is not my fault that I came back to India since I was only 2 years old.

What is the procedure for the same and what are the required documents?

Basic procedure is that first you will need to apply for a permanent resident travel document (prtd) to return to Canada. It's basically a visa inserted in passport, but for PRs. You lost your humanitarian and compassionate reasons there (basically, removed as a minor).

If granted you return to Canada and apply for pr card there. But first step is the prtd above. You should do that soon (it's good you are doing at 18).

I'd suggest you also look at the forum pr residency obligation here. There are some aspects of settling as a p in this situation r that can be challenging, like obtaining the social insurance number needed to work.

I do have my PR and social insurance card from 2007 as such.

Is it true that there is no "Expiry" status marked in any Immigration database for people who have an expired PR Card? Now if there is no "Expired" PR card, then CDC would need to reactivate my PR Card unique id in the system along with the social insurance card id, I think ..

Did your parents ever establish residency in Canada, meaning did they live here for a while before leaving permanently? This can impact whether IRCC considers granting you a PRTD under H&C.

Regardless, the next step is for you to apply for a PRTD under H&C based on being removed from Canada as a child. Good luck.

Before you worry about this, the first step is to apply for a PRTD and get that PRTD approved.

It's good you have a SIN.

PR status does not expire. PR cards are only valid for purposes of boarding a plane until their last validity date. It can be a useful document to show that you are (were) a PR, but as we said - you cannot do much of anything unless you get a PRTD.

Or, if you have a visa to USA, you could cross at a US border.

A few small bits:
-to cross at USA border, you do not need a current/valid PR card - your expired one would show you are a PR. Border guards will admit Canadian PRs even if card expires (in fact, they must).
-PR status does not expire but it can be revoked by IRCC for reasons, including not being in compliant with the residency obligation (as in your case).
-That could occur if the PRTD is rejected or at border (although you'd be admitted to Canada and given time to appeal).
-You seem to already know that humanitarian reasons can be accepted; we can't tell you the likelihood.
-In many cases the 'removed as a minor' argument seems to be accepted without issues, in others, not; other factors as mentioned by @scylla may influence this. Make the best case you can.

Would add that if you do cross via the US border and are not reported your may struggle to get a health card until you have a valid PR card or register as a domestic student at a college/univeristy. You would also have to plan on remaining in Canada for 2+ years without leaving. If you don’t want to leave anything to chance a PRTD based on H&C will allow you to know if you’ll be able to return to Canada and get a PR card right away.
