Renewal of work permit got refused

Hi,

I had a similar case..

My PGWP got expired,, then I was waiting for my spouse's PGWP to apply for my extension.. He got it after 4 Months, I had no status till 4 Months, Then I applied for Visitor's Visa and Restoration of Status Together,, and Got both of them.. Later n, I applied for my Open WP and now have that too..

So, I suggest you should apply for your WP and Restoration of Status Together

Hi gagan,
I think ur FSW application is still in process and they have asked you about current job.The most safest bet is to apply for LMO through ur old employer.You must offer him to pay for the fees which is 275 dollars and advertisement can be done on their behalf by you which i can guide you(Its free).But all this will take around 3 months.I dont know upto what time u have to apply.
Second option is to get old job letter in current date(In this letter they will mention your years of work and all duties ,pay etc which u got from 2010-2012.Also take new job offer on their letter head an finally send old experince letter with current date and new job offer plus write a covering letter to CIC mentioning complete details about ur current study after ur work permit expired but to the point only.
The third option is to RE-APPLY under CEC with correct duties,NOC code,salary and new letter from ur old employees.If posssible post ur CEC rejection letter..THis will help me to guide u in clear manner.

If u have lmo.. U can apply for wp and restoration of status together.. Pay fees for both..

Boss,dont worry at all.You are fully safe.Just tell us when is ur LMO issued.If it is still valid,immediately go to INDIA and apply from there and you will 100% get the work permit.If you want any kind of information for applying in india.Just tell me.I will help you fully free of cost.Dont waste time as these days strike of canada visa officers going on throughout world.Work is going on but at slow pace.Just leave canada immidiately and come back with new permit.

Hi raj. Iwas planning to apply work permit once again from canada i have been advised by few people that I should try from here first it will take 30 days for processing? will that be ok? or if i go back and apply from there then do i have to again go through medical examination and it will 50/50 chances if visa officer gives me visa or not. I havebeen in canada from 5 years but i dont have status now to apply work permit.

Hi can someone pls pls,,,Hi Raj I applied for fsw application in 2011 .i studied in 2008. On 2009 got my PGWP . On oct 2010 got my LMO from existing employer plus Arranged employment .I applied for work permit which expired last yr 2012..since then Im studying.......I applied for CEC file last yr .........exactly after 1 yr they Rejected it by saying your 2 of the duties doesn't match(I know it was meaningless as rest were matching only the wording used was different in rest).......I beared the pain of rejection,,,,,,now SOMEONE PLSSSSSSSS HEP ME I DONT WANT TO GET REJECTED AGAIN .......CIC sent me recently to update some forms and provide current reference letter from employer (job must be permanent if in Canada)..........My worries are what documents explanation to send to them ....what do i need at this point to have my file approved.......I am getting mixed responses from everywhere.......had spend all of my money everywhere....no help so far...someone plz help

OP, you'll ahve to go back to India my friend. share the name of your lawyer so no one else goes to him. it's tough situation, but you'll be fine.

The problem here is that OP's work permit has already expired, and his lawyer should have applied for restoration of status within 90 days, but applied on the 92 day.

Are you saying that you applied, outside of 90 days? Your case might be different, as your spouse had a valid visa, which automatically qualifies you, for some kind of visa.

Listen buddy,if u have some kind of status now in canada,then u can appply from canada.If no status then it is best bet to leave canada with valid LMO and apply from india.By this way u will not break any rule and u will come back legally.Ur un -authorised stay will harm ur PR chances as they will came to know sooner or later about ur overstay

I cannot find another employer to get LMO but i am elligible for the CEC and want to file for the same. so do i need to get the restoration approval before i put my file for CEC or just the proof of payment is sufficient.

Also should i go for visitor visa with resoration or wp extension with restoration. Also with out a work permit as in on the restoration period will i be elligible for the bridging work permit

Well, I'm not sure on the first question so I'd say wait for a senior.
For your 2nd question, you should apply for a visitors visa if you can't get an LMO. Your work permit application already got refused, so they'll refuse you again if you don't have an LMO.
For the 3rd question, no you will not be eligible as your work visa already expired.
