Hello,

I'm in a huge pickle. I just got back to the country so I don't lose my PR status. Here are the dates and I'm completely drawing a blank. I landed on 14 Oct 2008.

Here are the dates I was out of the country.

Dec 11, 2008 - Dec 14, 2008
Feb 5, 2009 - Feb 6, 2009
Feb 10, 2009 - Feb 11, 2009
Feb 23, 2009 - Mar 27, 2009
Sep 23, 2009 - Oct 2, 2009
(I see a stamp that I arrived in the US on Oct 11, 2009 but I don't see a departure stamp or a re-entry stamp YYZ)

Oct 3, 2010 - Sep 25, 2013

Can I re-apply for PR or am I in big big trouble? :(
I couldn't be here due to unforeseen circumstances and wasn't really calling the shots in life. But I'm back now and won't be leaving..

Please help.

You'll need to stay put in Canada for two years to place your PR status back in good standing. You can then apply for renewal of your PR card.

Each time you leave and re-enter, you risk your PR because each time you enter Canada, an immigration officer may realize that you do not meet the residency requirements and can report you for it. If they report you, it would be on you to prove that you meet the RO and if you lose that appeal, you lose your PR.

You must be able to show physical presence of 730 days in the 5 years prior to the PR Card renewal application date. As your prime absence has been at the back end of your 5 year anniversary from landing date you will need to remain in Canada for 730 days straight. This since the 5 year period started rolling forward daily effective Thanksgiving Monday losing you presence days pre Oct 2010.

Showing up at the border without a PR Card leads to scrutiny but the forum has examples of PRs entering on their Canada visitor visa exempt passports or US GC and seemingly being admitted as visitors...its roulette though one day you could meet a CBSA agent that will throw the rule book at you and report you.

What are the reasons for your absences? They could form H&C grounds.

I think I'll go with the 2 year stay straight up. I have a lot of reasons why I was absent, but I know they won't be acceptable as reasons for H&C grounds... :(
