Renew Canadian permanent residency card

Hi All,

I live in USA on H1-B. I got my Canadian permanent residency card through Alberta province which is expired in 2015.

Now i am planning to renew same and thinking to move to Canada. As there is 2 years gap and i did not stayed in Canada ( just few months).

What's process to renew expired card and explain reasons for delay in renewal.

If you haven't lived in Canada for 2 years straight, then you didn't fulfilled the residency requirement and you may not be allowed to renew your PR and you will have to renounce it. Unless you have very good reason why you didn't stay in Canada, CIC might approve your renewal application on H&C terms.

Do you meet the Residency Obligation (having spent 2 years of past 5 inside Canada)?

If you do meet RO, then you can cross into Canada by land border, or apply for PR TD to fly to Canada. Once back in Canada, simply renew PR card.

If you don't meet RO, then you have a serious problem and any attempt to go to Canada will most likely result in you being reported for not meeting RO and process started to revoke your PR status.

Since you were in the US on an H1B unlikely you would qualify for an H&C. You were working in the US that is not an extraordinary circumstance that prevented you from meeting the residency requirement in Canada.

It's not clear if you meet the residency requirement or not. You need to answer this question. In the last five years, have you lived in Canada for at least two of those year (730 days)?

It is very unlikely you will get your PR renewed. I would consider looking at your options. Would you qualify if you applied for PR again?

Wow. This is getting complicated so first I will need to be in Canada and then apply for renewal which won't guarantee if it will get renewed or not....
It's not complicated. You don't meet the Residency Obligation, so there is a very good chance that you will be reported upon entry, resulting in the loss of your PR status. If you are able to enter without being reported, you will need to remain in Canada for 2 straight years to once again meet the Residency Obligation; only after meeting the RO can you apply to renew your PR card.
