Removing wife from PR to get my own PR

Hi Guys

I need some serious advise here. I am living here in Canada while my wife is in Pakistan. We have been away since 16months and can't take it anymore. Due to covid our PR is stuck and there is no hope. Since all the inland applicants are getting PR so I am thinking to remove my wife from application and proceed for myself only. I will get PR and will return back to her.

Currently, everything on my application is passed except security. What you suggest is this a valid move and will this work? what are the implications of this?

Thanks
Umer

I personally do not think this is a good idea. If you do this, you will most likely end up being separated for longer.

Both of you have to pass the security check in order for the application to be approved. If you change her status to non-accompanying (you cannot remove her from the application entirely) and get PR on your own, you will then have to sponsor her for PR separately after you are officially a PR. You should expect this sponsorship process will take at least a year. While you are sponoring her, you must be living in Canada and only short trips outside of Canada are allowed (e.g. 2-3 weeks). Also, the chances are extremely high that she will not be approved for a TRV to come and visit you in Canada. So you will have to live apart for the better part of a year (on top of the time you have already spent apart).

That is my opinion. Obviously up to you.

1.- divorce?
2.- are you going to sponsor her, later?

**for me, it is important to have a legal advice**

If you try this your move, it will jeopardize your marriage. You'll not be able to sponsor your wife, Cic will deem you single forever and your wife have to come to Canada on her own merit.

Please don't make this mistake even if you're in a common law. Unless you're getting a divorce

So if I understand correctly, you have applied with your wife and everything is passed except security - and you think that removing her from the application will speed things up? Not sure why you would think that, but you are dead wrong - the security check applies to both of you, so assuming you are from Pakistan also, there is no reason to think that she is the reason it is taking so long. Trying to change her status from "accompanying" to "non-accompanying" might take longer.

If you have reason to believe your wife might be deemed a security risk, that is a completely different matter, and you'd have to ask yourself if she would ever be admitted to Canada.
