Remarried before divorce process finalized.

Hello Everyone,

I am new on this group, I wish to immigrate to Canada however there is a complication with my case, on which I wish to seek your advice.

I am Pakistani citizen where polygamy or Dual Marriage is Legal. In 2016 I temporarily went to mexico and there I married a Mexican women, I only spent 2 months with my wife then left the Mexico completely and afterwards I was unable to contact her for the divorce, I got remarried in Pakistan in November 2018 and then I immediately hired a lawyer in Mexico to file my divorce for my previous marriage but it hasn't finalized yet and it would still take 3 to 4 months at least to get the divorce certificate.

So my question is that in Canada Dual Marriage/Polygamy is illegal, so will my application for immigration through express entry will be rejected due to this reason? Or should I wait for the divorce finalization? Or should I apply now and show that the divorce case is pending in the Mexican Court?

Me and My wife both has completed the WES and achieved the required IELTS score and our CSR score is 458, I can submit my profile immediately.

I would appreciate any advise or guidance on this.

Your second marriage is not recognized by Canada since you married your second wife before divorcing the first.

You will either have to wait for your divorce to be finalized and then remarry your current wife to make your current marriage legal for Canadian immigration purposes. Or you will have to wait until you have lived with your current wife for a full year so that you are classified as common law and can include her in your application as a common law partner.

How you do the marriage will be dependent upon the legal process of the country you are in. As far as Canada is concerned, you are not currently married to your second "wife". To be accepted by IRCC, it must be legal both in the country that the marriage was performed AND in Canada.
