Hello everyone,

I was re reading my application and came across this question in the applicant's form:
Have you, or if you are the principal applicant, any of your family members listed in your application for permanent residence in Canada, ever:

6)been refused status, an immigrant or permanent resident visa (including a Certificat de selection du Quebec(CSQ) or application to the Provincial Nominee Program) or visitor or temporary resident visa, to Canada or any other country?

Does this question also imply student visa? I was refused student visa to US early on, so now I am wondering if this is going to affect my application in any way as I answered no to this question. :S

please help.any suggestions asap please.

You should have answered yes. You need to contact the VO processing your application and correct this error asap. This is misrepresentation which could cause you file to be refused.

ohhh it did not mention student visa in the questions..only about resident or temporary visa??

When it says 'an immigrant or permanent resident visa ... or visitor or temporary resident visa, to ... any other country' it is referring basically to any kind of visa. Each country has their own names for the different types of visa; they can't list them all here; so that wording is meant to include all types of visas.

You should definitely have said 'yes' and explained about your rejected US student visa. If the visa officer finds out, your application will most likely be rejected for misrepresentation.

The best thing to do is to redo that form, stating 'yes' to that question, and attach an explanation of the rejected US student visa application. Also explain why you answered 'no' in the first place: saying you misinterpreted the question and thought that it did not refer to student visas will be OK. Then send it to the visa office that is processing your application, to be added to your file.

I also selected no for this question, but had a refused work permit extension for Canada in 2010 based on unsuccessful LMO. I interpreted the question the same way, thinking that I was not refused a refugee, PR, visitor or temp resident visa so I am not included in this. I wasn't refused entry as I was already in and was not asked to leave, I was given a list of other options such as finding a new employer to get a LMO which is exactly what I did.

I am interested to see if anyone else has any thoughts on this - are refused work permits and student visas included in this question?

I think I will send an email to my VO about it and include relevant details and new copy of the form to be on the safe side anyway.

Ya i called cic and told them abt my situation. She said write the form no and question no. and send the letter to new delhi vo explaining the mistake. I asked if this will cause a delay or any problem with my file? She said since no decision has been made yet, it should not be a problem. Also, i asked her if i should redo the form and attach with letter. She said not needed and that i should wait for further instructions from the vo.

Soo now.. A couple are suggesting on the forum to send the form. But the cic call centre agent told me its not needed. So what should i do?

And rachly, yours was an extension that was rejected. Not an entry visa. So perhaps you are ok. But perhaps it doesnt hurt to let the vo know about extension rejection. Why dont you call cic and see what they have to say about your situation and follow their advice.

It's really probably best to cover yourself and send the re-completed form stating "yes" you have had a visa rejected before and also send the page typed for your explanation as to why u are changing their answer. Why wait a few months down the line for u to send the form filled in correctly? They will most likely want the correctly completed form in their files. It will literally take 5 minutes to re-do the form.

When someone calls the Call Centre, you can get 3 different answers from 3 different people. I would definitely send the letter explaining the mistake to the New Delhi visa office as soon as possible. Including a copy of the redone form cannot hurt you, and it could be the visa officer will want it, so I would send it too, even though it is not necessary according to the Call Centre agent.

Thank you for the replies. Yes, I have decided to send in the re-completed form just so that they can have it for their records. As I was re doing the form, I realized that another question below part e)been refused admission to, or ordered to leave, Canada or any other country?

Is that answer same as part d as being refused for visa?

I want to make sure about this question too before I send in the re-completed form.

The refused admission to, I read that as, u show up at the door of the border and then an agent tells u, "you can come in here. Go back home." But whether u check off, yes or no, just explain yourself and there shouldn't be any issues regarding your answer.

i called cic again to ask what they meant by 'refused admission..'. I too thought it meant I arrived at the border and the officer turns me away. But the call centre agent said no thats not correct. and he said I should have answered that question as 'yes'. I told him I never left India at that time of application. He said it would still be yes. So, anyways, I wrote a letter again to new delhi and explained both the questions and emailed them the corrected form yesterday. I have my fingers crossed now and hoping for the best.

e) been refused admission to...any other country...the answer should be YES. You were denied the visa, so you were also refused admission, even if you didn't leave India...

That's how I interpret it...

This is why they should make the questions clearer so that there is NO NEED for interpretation!!

Not sure that I agree with these answers.

A work permit or a student permit is NOT a temporary visa. Typically, if you are issued one of these permits you ALSO need a temporary visa to actually enter the country if you're not from a visa exempt country.

In other words, I can't speak with certainty for the USA, but for Canada you are issued a student permit and you are also issued a temporary resident visa so that you can actually enter the country if you're not from a visa exempt country.

So, by having the student permit refused, were you refused a temporary visa? Not at all clear that the answer is, yes.
