Hey guys among the reasons I was refused a study permit is my immigration status:

"I am not satisfied that you will leave Canada at the end of your stay, as stipulated in subsection 200(1) of the IRPR, based on your immigration status."

I have been on a valid work permit for the past 6 years in Malaysia (not my home country) and apparently it's a problem.

Any Idea how I can address this?

Thanks

Yes, you are living and working in another country. You need to show strong ties to your home country and show how a Canadian program will advance your career in your home country.

What level of study were you planning on taking in Canada? If a diploma, then go for a Master's at a good school and you may be able to solve this refusal reason.

Yeah, I actually have an offer for a master's in entrepreneurship from Ryerson University. My reasoning is that I have been working for over a decade for other people and I want to set up my own business now. I have even built the website and everything and it's a legit website... been working on it for over 2 years.
Also, my business is related to my experience, and I want to take this course so it can help me start my business.

Yeah, I think I have some problems there.
I don't have any property in my home country (Iran) but my parents do, and they all live in Iran. I don't have any family members in Canada actually. Everyone's in Iran.
I explained how I want to set up my business in my home country after my master's in entrepreneurship from Canada, and I explained in detail why Canada and why not other countries.

Another issue I think is that my common-law partner is from Thailand, also working in Malaysia, and while I applied for a study permit, she applied for an OWP. i don't know whether that has made the officer think we won't leave Canada as well...

Hi @alig2121

I have a similar case as yours. I just submitted my application and fret the same response from IRCC.
Possible for you to share your timeline?

Thanks

The fact that you have not lived in Iran for quite some time and your wife is from Thailand makes it very unlikely that you would both return to Iran after your studies. You don’t have the ability to return to Malaysia so you would need to prove that you could return to Iran. Would suggest requesting GCMS notes.

Thanks for the reply. Yeah, I have already requested it 2 weeks ago.

May I know that is the VO looking for us to leave Canada at the end of the study or specifically return to home country.

My argument was that I am going to start an import-export business from SE Asia to Iran for products that I have experience working for about a decade. I already have the website and everything, and that's actually my real plan. My partner's parents are also in the same industry which we are planning to partner up with them as well. But I don't know how to prove it.

Business plan?

I have a pitch deck, and I also included a short executive summary to my LoE, but if I thought if I include more it might be too much.

Oh and btw, I want to study entrepreneurship to be able to write a proper business plan..

The fact that you are trying to expand on your in-laws business and you have lots of experience in the field means that it doesn’t make a lot of sense to spend so much money going to Canada to get an education. There are lots of good schools in Asia and writing a business plan doesn’t require an MBA. Why Canada wants people to prove that they will return home is a bit confusing. I assume they want people to be able to show that they are genuine students and their degree will lead to career progression.

Hi Canuck78,
Would this problem happen to us? My wife is Indonesian applying for SP while I'm Vietnamese applying for SOWP, and we are living in Vietnam, not in the 3rd country.
TIA and have a nice day!

Does it specify not returning to your home country? Many spouses are not granted SOWP because they aren’t guaranteed to spouses of international students.

No
Only return subsection 200 01 of the irpr based on your immigration status.
