Dear Friends,

If you read this mail, please reply because I did not sleep properly for last 4 days thinking about the solution of the below problem. I request YOU to please reply. My future is on stake.

I was in Canada on student visa from 01-2008 to 05-2010. I Completed my 3 out of 4 semesters and then because of financial constraints, I stopped studying on 06-2009 (after 3 semesters completion) and started working on cash in Canada. I worked on cash for around a year (without registering to any college) and finally because of financial conditions again I had to move back to my homeland. I left Canada when my visa was still valid for 1 year more on 05-2010.

Now the problem is, after completing my 3 semesters I applied for Canadian immigration from Canada on 07-2009 . My file was in buffalo and then transferred to Ottawa . 4 days back I got my MEDICAL and RPRF and they also asked me the updated proof of my studies in Canada , since I provided them 3 semesters transcripts they are asking for the completion transcript.

NOW as I said, I did not studied after 3 semesters and worked in Canada for around a year from 06-2009 to 05-2010 without registering to any college. So How can I fill this 1 year GAP since I was there in Canada? and Do you think if I tell them that I was doing nothing during that 1 year, they gonna reject my file?

There are many posts in this forum but I believe this post deserve your input, please share your views.

I see no reason why they should refuse you. You did not lie so far.
You were in Canada in legal status,,,,,did you have an off campus work permit? I Know students are permitted to intereupt their study for financial reasons,,,,so if you have the work permit and send them a letter explaining why you stopped studying and left, I think there will be no problem.
But before you do anything, post your question to this immigration forum on linkedin. There are many immigration consultants there and they can answer you question with more certainty

Dear Friend,

As a student we are not allowed to work in Canada. Full time Work permit is only given after program completion which I did not . I cant even tell them that I was working, since I was not allowed.

I was Idle for ONE YEAR in Canada. How to fill that GAP now?

You can write "unemployed" for that period.....
 
You can put medical leave, if you know somebody in Canada in medical field ask them to give a letter even from a small clinic stating that your back is injured while you lifting something in the home that's it ,everything will be alright ! No need if medical bills by Canada law , as a person is non Canadian who doesn't have insurance or unable to pay any doctor can treat you for free so take this option the best solution ,I am in Canada too
 
Your options are next to none in this matter. Did you apply to immigrate to Canada on the basis of your Canadian study ?. If yes, CIC is assuming that you might have completed your studies in Canada and that study resulted in a degree or diploma being awarded to you. This is the reason why CIC is asking for a completion transcript or certificate. You did not complete your course of study and thats why nothing has been awarded to you. If you can chalk out something with your education provider, that will be good. If you can't sort it out than "rejection" is inevitable.
 
A few questions:
1. what did you write for highest education attained on the background declaration form?
2. what did you write for name of credential/certificate obtained for the 3 semester study period under the education section?

If you claimed to have received a degree/diploma from the school you attended when you did not, you have committed misrepresentation and you are in big trouble. It is punishable by a ban of 2 years and possibly deportation.

Thanks for your views. I have 12+4 (BBA) and then 3 semester completed transcript from Canada. while filling my forms I did not claim for canadian diploma points.

In total years of education question, I mentioned 17 NOT 18. So even they don t give me any point for 3 semester transcript my points are still well above 67.

The only worry is how to justify my idle time (1 year) in Canada?

Suppose If I say, I was doing nothing they might say as per law Intl. student has to register in any college /Uni bla bla bla.

Please suggest me any proper excuse which would save my application.

Dear Schule, can you please provide more details like the Category you applied under ?. Did you calculate points including 5 points for 2 years study in Canada ?. What NOC did you applied under?. You obviously breached your visa by not enrolling in a course of study. An international student can only skip one semester and in case you want to skip more, you are to provide proof of compelling circumstances for that. Please provide the breakdown of your points.
 
What did you write for that year in your "Section A - background declaration" form?

Anyway, I think CIC is asking for the degree/diploma you would have obtained from your studies in Canada. Obviously you didn't finish the program.
Have you spoken to a lawyer?
