REJECTED for no Apparent reason?

Hey!
My name is Josh and i'm from Germany
I have decided to study at Camosun College in Victoria BC and have received my Letter of Acceptance and paid my $5000 deposit.

The College told me that I can apply for a Study visa while being IN CANADA which I double checked by asking people in this forum. I filled out the form and applied and waited 3 months to receive this:

This letter refers to your application for a Study Permit. Your application as requested is refused.
[X] You are not a person described in Immigration Legislation who can apply for this type of document from within Canada. An application of this type must be made at a Canadian Visa office in another country.

What the..... ? my studies start in September and literally everyone told me that i'm able to apply from inside of Canada.

Since i'm not a big fan of going back to Germany id rather go to Seattle and get an immigration lawyer to assist me with my application.

Question:
a) Does anyone know what the F just happened?
b) Anything I have consider applying from the united states?

"If you are in Canada as a visitor and wish to apply for a study permit to attend a designated learning institution, you may be able to do so from within Canada. As of June 1, 2014, certain foreign nationals may apply for and receive a study permit from within Canada. These include:

minor children studying at the primary or secondary level;
exchange or visiting students; and
students who have completed a short-term course or program of study that is a condition for acceptance at a designated institution"

sorry I wouldnt know. people say they have applied through LA but not sure if they r successful

i will advise you reapply online and if you get to which country you applying from then click germany. but you must be ready to submit your passport to canadian embassy in germany incase you got passport request or submit to the office that process german applicant.

instead of wasting time wth a lawyer.

Mead clarifies on your first point, as you are not eligible to apply within Canada.
It is easier to reapply than contest the case, even if you win court will assign a different VO to go through the case. Reference is different immigration law firms you can search and find case on internet.
Now you can only apply visa through a third country, if you are a resident (work, study, alien immigrant) in that country. If you have B1/B2 you cant apply from US at all.

Hi, I know this is an old subject, but I got the same refusal, just my situation is different.

I am a visiting student doing a 6 months research project in Ontario at McMaster and applied for a study permit from within Canada to get a SIN Number and work on campus.

So in the end the question is why am I not applicable to apply from within ?

What do you mean you are a visiting student? Are you a student now or in Canada on a TRV. If on TRV, you apply for a study permit and it is processed from your home country. You apply “within” only if you meet certain conditions (spouse on work permit or study permit). If you are doing a research project are you taking courses or working? If not studying, you apply for a work permit with a LMIA.

Ok I am here on eta but i am getting a scholarship from the University and therefore need a SIN Number.
To the University I am a visiting student doing research. So I am enrolled, i am not getting paid, but i get a scholarship. I am from Germany and since I am staying less than six months I wouldn't need a study permit if it wasn't for the SIN number.

For my understanding I need a study permit to do on campus research work.

I hope I am giving a clear overview of my situation, i appreciate your help!

This only applies if you want to stay beyond the period of your exchange and take a full program in Canada that is 8 months or more (full time) in length. In that case you would be applying to convert your status to a study permit and can do that from within Canada.

You're only here for six months so getting a study permit and SIN isn't possible / doesn't apply.

So why do you want a SIN number if you are visiting student. Your program is not more than 6 months so you don’t need a SIN.

So to get a study permit, you need a letter of admission from the university showing your acceptance into a program. Then you apply for a study permit. It can be processed from within Canada.

Or are you a worker? If you are working for the faculty.

Talk to you university advisor.

@scylla that would explain it but would be really badly written on the page in my opinion. In that case I would only have one follow up question, am I getting back any of the 235 CAD (150 study permit fees, and 85 biometric fees ) ? Especially since no biometrics were involved in the whole process?

@Naturgrl i need it because I am getting a scholarship for my stay and they can only give out money with a SIN number. I am in contact with my advisor at school and she said to get a study permit... I am doing research work, as a visiting student so I am not getting paid therefore I am not a worker in the conventional sense at least, i am more of an intern
