Regarding withdrawal, Please help....

Hi,

If our job is not listed in the 38 most wanted job list, but is listed in the retainer job list and we wish not to pursue any further with the immigration program, would we be able to get a refund of the money that we have paid to consultancy and high commission.

If you withdraw your appliation before they start to process it, you can get a refund of your processing fees, see http://www.cic.gc.ca/english/information/faq/immigrate/skilled/skilled-faq12.asp

If you had paid a consultant or lawyer to help you with your application, that's another matter you would have to take up with those individuals.

You'll probably not get a refund from the consultants - check your contract.

As for the high commission, I don't know at what point "processing" actually begins. I don't know if that's when they put your file in the system (and give you the file number), or when they actually contact your for data/documents.

Well, according to the FAQ (http://www.cic.gc.ca/english/department/laws-policy/irpa-faq-how05.asp) you can get your application fee refunded if you withdraw it.

Not sure about the agreement between you and your consultant. You need to check with them.

Although the online status shows "In Process", it doesn't mean they have started processing your application. We can tell this by those "confirmation letter" sent by CHC to some applicants 2 years after the application date, asking them whether they are still interested in immigrating to Canada. I guess this is an indication that they are finally ready to assess your file. I believe the actual assessment starts when CHC contacted you for detailed documents.

It also says in the website (http://www.cic.gc.ca/english/department/laws-policy/irpa-more.asp) that "Applications not processed in a given year can be held for future consideration or returned with a full refund to the applicant, who will be welcome to reapply at another time.". I guess that is for applications that are not on The List.

yes in case of rejection if you've applied under simplified application process you'll get full refund from cic but if you are in the list or you r in their que for future consideration then you can not get the refund but some ppl are getting a letter from cic regarding their intrest in immigration like if they still want to continue or withdraw ... so if they reply to this mess that they wanna withdraw their case then they'll get the refund ... so if you get this letter meanwhile then you can get your money back according to that letter.... so hope for the best

Nobody knows right now what the new rules will be exactly but according to http://www.cic.gc.ca/english/department/laws-policy/irpa-faq-you06.asp if they were to decide not to process your application, say your occupation is not on the priority list and they had decided not to process those files at all, they would refund you the money.

This whole FAQ on the new rules can be found at http://www.cic.gc.ca/english/department/laws-policy/irpa-questions.asp but until the new rules are actually posted, it's not really clear. According to http://www.cic.gc.ca/english/department/laws-policy/irpa-faq-how05.asp if you withdraw, you can get your money back.
