Regarding spouse not accompanying

Hi all.
My spouse and child are not gonna accompany me.. they ask the reason for not accompanying.. reason is some domestic issues i.e ailing mother so have to take care of her ..but i was told that the reason should be demonstrable..How can i demonstrate care giving?? Also she is doing job with 2 years contract but one can quit the job for canada...what possibly best can satisfy the visa officer so he must not consider it as misrepresentation by any means??.

Hi

If her mother is truly ill, then it's perfectly fine to say that your wife wants to stay with her for now. You don't need to prove that.

I have a similar question. I am applying for PR under CEC class having 434 points. Right now working in Canada and staying with my wife. I have valid work permit till next August and she too has valid visitor record till then. If I include her, i am getting 434 points. If I do not include (Say yest to 'Spouse does not come with me to Canada'), my points will be 460.
My question is:
1. If I do not add her to my profile and if I get PR in next few months, can she stay with me till next August as she have valid visitor record?
2. What is the process to apply PR for her in future and what is the processing time?
3. If do not include her then my points will be 460. If my profile is picked in next draw(For example, cut off is 430). Then can I include her after I get ITA?

Actually my mother is ill so i and she have decided that she should stay with her and take care of her ...Is it ok??

From your post, it is obvious that you have decided to exclude your wife from your application so that you can get more points and get an early ITA. Your wife has a visitor permit which means she wants to be with you and on that basis CIC granted her a visitor permit. If you exclude your wife in your PR application, you could be refused for misrepresentation unless you give CIC a convincing reason why you have not added her to your application. Not having enough points isnt a valid reason. There is a limit to how long she can stay in the country as a visitor and she would eventually need to leave. Sponsoring her visa at a later stage will take at least and year and you both would be living apart that long.

You definitely cannot add her after getting an ITA as this can be a case of misrepresentation. And the penalty for misrepresenation is a 5 year ban, you dont want to risk that, either!

I, too was planning to do the same, got ITA on 1st March without my spouse in my EE profile. But declined the ITA and back in the pool with updated EE profile, waiting for the next draw, hoping for an ITA.
