Refused Visitor Extension- Apply for Express Entry

Hello Members,
I am wondering if anyone has an idea what can be done in this situation.?

A sister H&C application still in progress, however her visitor visa just got refused.(here as a visitor while waiting for H&C)

Can she apply for Express Entry ?

Is this your sister? She either has to remain out of status, pay for a judicial review or leave while H&C is in process.
