Refused Study Permit Restoration - Out of Status - Spousal Sponsorship

1. Why did you need a "registration letter" to renew your study permit? Transcripts and a recent letter from the school attesting that you were a full-time student during the past academic year (September 2013 to April 2013) is sufficient.
2. What reason did you give for renewing the study permit?
3. Did you include proof of funds?
4. It is unusual for CIC to refuse study permit renewals unless they believe you are not a genuine student. That is, you were not enrolled in school in the last semester/academic year, failed your courses, etc.
5. Did you apply for restoration AND the study permit at the same time? If not, this is what you should have done.
6. A departure order could make it hard to receive any temporary status in the future. So obtaining a positive LMO is no guarantee a work permit will be issued.
7. Speak to an experienced immigration lawyer(not consultant) asap to explore your options. Failing that, prepare to leave Canada before the 30 days are up and make sure CBSA(at the airport) are aware you left.

Hi everyone,

Here's my situation.

# My study permit was expired on July 30th, 2013.
# Due to delayed registration letter from school, I was unable to apply for extension before August 5th.
# Even though I have applied to restore my status within the 90 days (5 to be specific), I got refused & received a "Departure Order" without any date (assuming it automatically become "Deportation Order" after 30 days).

# I am engaged to a Canadian Citizen
# (Even though initially we weren't) At this point we are planning to get married asap (within the 30 days)
# We did not/do not wanna rush the spousal sponsorship application/process
# I can get "Managerial Directorial" employment letter (LMO could take more than 30 days)

If I leave -

# It might be extremely tough for me to get back in
# I will loose thousands of dollars

I know I can stay once the spousal sponsorship application has been submitted but if I wanna take time with that, what are my options at this point if I wanna stay here (without breaking the law)? Any type of inland visa? Or should I just rush the sponsorship process?

My wife is in same situation and her status is expired from last 5 months and i am permanent resident, i dont know what to write in explanation letter for out of status. Can you please help me with that.

Any other suggestions also be appreciated.

You are reviving a very old thread so the original poster may no longer be around this forum..

Why do you need the explanation letter? To apply for PR? How did she come to be out of status?

Be honest in your explanation. Be clear with your timeline about how you came to be out of status and why.. All you can do is explain what honestly happened.

I have a restoration of status app in at the moment (slightly different circumstance) and that is what i did.

Okey thats undestandable, the other thing i want to know is there any seperate helpline for these marriage applications or its same cic no.

Its just one number then when you call you are given options... Press 1 for xxxx 2 for xxxxx etc.
