Hello sir Zee 81 and other valuable members,
i need ur guidence regarding my case.The details are as follows
1. i am an applicant from Pakistan.
2. i submitted my application for Federal skilled workers immigration through my consultant
3. My application was submitted with islamabad visa office in April 2010 with NOC 4131
4. My case was refused in april 2012 on the plea of duties mismatch.
5. I filed an appeal through my consultant in april 2012.
6. the consultant company has been closed by government on various charges in November,2012.
7. i donot know what happened with my appeal as the email address was that of my consultant.how can i know about the result and furthermore how to change my email address
8.how can i get my CAPS notes and will that be useful if i go to federal court for appeal.

Dear baby123

First of all i would like to remind you that you have wasted precious time from April till date... You should have taken immediate action by chasing the consultant as the case re-open appeals have to be closed within 60 days of refusal by CIC.... Your consultant might have got response in either way from CIC within 2 months of generating the appeal (if they forwarded the request, which i doubt as the company was closed by Govt. which means they were frauds as i believe!!).....

Anyhow you should do following actions immediately...

1. Send an email to CHC London at;

london-im-enquiry @ international.gc.ca

Quote your B-File number and inquire about the status of your case... Also check the status on E-Case (if its still 'Decision Made' then you have very less chance to get it re-opened).... E-Case link is:

2. Order CAIPs if you want the inside story of your case (what the Visa Officer actually commented on your file), link to order CAIPs is below:

You have to pay CAD25 through Western Union.... It will take 45 days after you confirm your order... you have to sign in some forms which they will let you know...

3. You can send a request to CHC to change your address/email etc (once you open the E-case status option is available to change the address etc)...

4. You can chase the consultant or their representative if possible to gather information about your case that what actually happened? (Although difficult to do this as people will not cooperate!!)

5. Remember, to file an appeal in Federal court, you have to do this within 60 days AFTER the RECEIPT of your refusal letter....

6. You can send a request to CIC to refund your application fee as you are eligible for it, if you do not want to chase CIC further.... Send an email to following address to ask for the refund (after confirming your Case status)....

This refers to your application for permanent residence in Canada as a member of the provincial nominee class.

I have reviewed your application and all of the information you have provided in support of it and it appears that you do not meet the requirements for immigration to Canada.

Subsection 11(1) of the Immigration and Refugee Protection Act (IRPA) provides that a foreign national must, before entering Canada, apply to an officer for a visa or any other document required by the Immigration and Refugee Protection Regulations. The provincial nominee class is an economic immigrant category. Economic immigrants are defined on Citizenship and Immigration's official website (www.cic.gc.ca) as being "selected for their skills and ability to contribute to the Canadian economy." Subsection 87 of Canada's Immigration and Refugee Protection Regulations (IRPR) describes the provincial nominee class as "a class of persons who may become permanent residents on the basis of their ability to become economically established in Canada" and who "are named in a nomination certificate issued by the government of a province under a provincial nomination agreement between that province and the Minister; and ... intend to reside in the province that has nominated them." The definition of provincial nominees is further explained on www.cic.gc.ca as "Economic immigrants selected by a province or territory for specific skills that will contribute to the local economy to meet specific labour market needs." In order for applicants to become economically established it is therefore expected that they will be able to obtain employment in Canada. Nominations issued by provinces are considered as initial evidence that nominees have the ability to become economically established in Canada and will be of economic benefit to the province and have met the requirements of the province's Provincial Nominee Program. Canada is responsible for exercising the final selection authority and ensuring that applicants admitted under the program have met the requirements for membership in the economic class. Notwithstanding your nomination by a province or territory, I am not satisfied that the information provided with your permanent residence application indicates you have the ability to become economically established in Canada or that you otherwise meet the definition of a provincial nominee as per Subsection 87 of the IRPR.

You were nominated in the Family stream of the Saskatchewan Immigrant Nominee Program (SINP). We have received notification that your relative in Saskatchewan, Mr. Brother-In-Law, no longer supports your application to come to Canada. As the relative who initially assisted you to become nominated under the SINP no longer supports you, I am not satisfied that you would intend to reside in Saskatchewan or indeed that your initial nomination under the SINP would still be considered valid.

A copy of this letter is also being sent to the nominating province to advise of the possible refusal of your application and the reasons for it. The province has 90 days to raise concerns or seek clarification from the visa office regarding the assessment of your application, after which the final decision will be made. If you have further information you wish to have considered, you must submit it within the same 90-day time period.

Sir, Alhamdullillah we won the Appeal in feb-2013 and now preparing updated documents to send, can you help us to know what actually are the documents we should send??

Congrats Julieana, great success for you....

Well CHC London will send you the details of updated documents required by them.. Mostly they require some IM forms like Schedule 'A', IM0008, Schedule 3, Back ground declaration forms etc.... Updated Police certificates, Travel history details and photos...

Nothing to worry, just wait for them to request the updated documents (if not already received)...

Dear Sir

File your appeal directly with LVO , and state all facts about your consultant . This wuill help you.
