Refused PR due to wrong NOC code

Hi Guys,

I am really struggling on what to do next.... I have until March 2018 until my 2 year work visa is finished.

I applied for PR express entry using my foreign work experience, I worked as a Network Controller for a transportation company. This role I managed and supervised the network I felt like my role went with NOC code 1215. I had the employment letter from my old work and it matched well with this NOC code. The immigration Office refused me advising they thought my role went better with 1526 - Transport Scheduler. The code they coded me as are the people I used to supervise. I did put in one or two factors from this code but the reason I did this was because in NOC code 1215 it states " May carry out same duties as clerks"

This being said the immigration office refused my application based on this. I still feel the correct NOC code is the one I put. I have since been in contact with my old employer to ask for a more detailed letter which he has provided and its very similar to the old letter. It has just gone into more detail of my roles.
I did seek legal advice, they advised I can appeal the decision .... but for me this is too much money ..... He also mentioned I can re apply using this new letter and a good explanation as to why.... but there is a chance the immigration officer can still refuse it.

I do have another work experience I can use which was stated in my application but I didn't use it. this was only a year experience and only brings my points up to 447 which is not enough based on the last few rounds....

I am just so scared. ...... going home is not an option everything is here for me. I am preparing for the worst

Just wondering if anyone has been in this situation or has any advise.... Help would be much appreciated .

This is my opinion. Others may differ with this.

Try making two profiles at this stage. One with the new experience that you mentioned which makes your score 447. There is a chance that the CRS may drop to this level or below in the next draw. The second profile you can make with your old experience but this time use the NOC code of 1526 as stated by CIC. I know that you feel that this code does not matches your duties but at this stage it is better to side with CIC.

Wait for the draw to happen. If you get an ITA with your 447 profile then go ahead with it and refuse the other one.

I should mention that you have to show on your application that you still have a year on your work permit, which you don not have apparently. You may have to consult somebody about this.

It may take 6 months or less/more to get a PPR. I do not know whether by March you will be able to get your PPR or not but you may want to explore bridging your work permit. You will need to check into this. Even if you are back home, you can request CIC to change your visa office to that in your home country, once you receive your PPR.

Thanks for your quick response.... I know I can apply for a bridging visa after I have applied which is something I will do. The other code they coded me does not give me any points as its listed as Skill set C..... This is the wrong code. I have a new letter and was thinking to re apply..... with this one as the new letter is more in depth... its just more risky.
