Hello everyone,

Today I received an email that my wife's PR application was refused. I do admit, it was our fault because the police check was not complete and we failed to see that. From here, I am confused as to what to do next. I'm wasn't told that my sponsorship application was forfeited, only the permanent residence application due to insufficient document information. Should I resend to the email they've given me the corrected document with my application number requesting for a resubmission to the IRCC officer or do I have to resend the entire sponsorship application again?

For reference, I'm sponsoring her from South Korea where she is currently residing.

You have to resubmit the entire application - both the sponsor and applicant sections. You'll be applying again from scratch.

You can certainly try submitting the missing document with a request to reopen the file - some small possibility this will work. However generally speaking, once you're refused you have to reapply from scratch.

You can request a reconsideration and provide the required document. There is no guarantee that they will reopen your file, but they are required to consider the request. If they refuse, you will need to reapply.

After doing some research, I have found out that it is illegal to obtain any additional lapsed criminal records from South Korea. My spouse has been trying to go to several police station but refused without any consideration. Would this make my sponsorship completely useless just because of the conflicting laws between both countries?

I am quite certain thats not the case as people have migrated from South Korea to Canada in the past. https://www.canada.ca/en/immigratio...lice/police-certificates/how/korea-south.html

The link clearly outlines the steps so I doubt its the case.

Yes I do understand that and we have went through that guide. In the past, there was an option to select the lapsed records and they would give it without any issue. To our understanding, the law has changed in recent years in South Korea making it more difficult to obtain the lapsed records. The guide does not compliment with Korean laws anymore. They say USA recognizes this change and they no longer ask for it for their citizenship but Canada seems to still ask for it despite it being illegal.

Hello all,

I just had my PR application refused. It was paper based and although my process was linked online, I didn't receive any communication in ircc website. And the email they sent, got on my husband spam email box and we didn't saw they requested more documents (the sender was MXICOIMMIGRATION@international.gc.ca, not the normal one that we always got emails).

Do you think I could request a reconsideration? If yes, how I do that? Just replying the email? I'm trying to search on the internet about, but Im not finding much about.

Thanks.

You can certainly try requesting reconsideration. It's really impossible for any of us to say if your request will be considered. You want to raise a case specific inquiry rather than emailing them.
