Good day guys,

I am an international student from Ukraine, have been since 2014 at the Seneca college.

Little pre-history:
I have my last semester to finish (3 subjects)
My previous semester which I finished was in April 2017, in July 2017 my study permit would expire.
I was waiting for a money transfer from my parents longer then usual this time,( unplanned unfortunate expences in my family) to be able to extend my documents I need to pay 3,000.00$ as a deposit to my college. So I could not do it in time before July 2017, so I went to the international student advisor and he told me that I can be legally in country 90 days after my documents are expired and apply for extension, if I will not have money until that time (3 months) I should leave Canada and apply for a visa and permit again from the country of residence (Ukraine)

That is what I did, I left Canada almost 90 days after and went home. When I finally got the money for college I applied for a student visa in Ukraine and got refused. (( Even though my education in which I have invested a LOT of money ( you know how much international students are paying) is not finished. I have all my life literally in the different country together with all my stuff.

Reasons for refusal were
1. I am not satisfied that you will live Canada at the end of your stay.
2. I am not satisfied that you are currently attending classes and seeking to complete the program of study in a reasonable time.

just to clarify I WAS NOT attending classes.

So I gathered even more documents and applied again for a student visa and permit to be able to finish my college! that's all I want, receive my Diploma which I believe I deserve and this situation is so UNFAIR.

I am getting the second refusal in Visa
with comments :
1. I am not satisfied that you will leave Canada ..... i mean again? I explained everything in my explanation letter.
2. I am not satisfied that you will leave Canada based on your family ties in Canada .... WHICH I DONT HAVE

Maybe ...somebody had this situation before.. I am lost, I am stressed I don't know what to do.
Right now I am waiting for an answer from cic I requested 'request of information act"

P.S. all this time 4 month I am paying for my apartment in Canada and I don't live there
 
Actually u did a blunder , you should haven't leave the canada.You should ve been go along with the process over there . Yes u would be illegal at that time but still now it has become an concern for u.
See , now you have to show strong finances. Which in turn can help u to get visa.With an explanation letter (SOP). Moreover, transfer yiur fee to college atleast for 1 year if ur study is left nearly for 1 year if it is for only sem transfer for 1 sem. Then again re apply and show wired reciept. Living Expenses.

The adviser gave you bad advice. You were in Canada for 90 days without status after your study permit expired. You were not in Canada legally during this time. That's most likely part of the reason why you were refused.

Did you work at all after you stopped attending classes?
 
In my previous refused study permit, my father's name was misspelled due to typo errors, now, I am reapplying again, can i use the LOE to explain and state the correct spelling, or I should add a sworn affidavit to prove the correct spelling?

Yes i did.

You were working illegally in that case. That's not helping your case for returning.

You can try reapplying for the study permit. Your case is difficult since you were out of status in Canada for a number of months and also worked illegally. From CIC's perspective this represents an abuse of your study permit privileges and makes CIC concerned you will not follow the rules in the future.

I would order your GCMS notes before you reapply and see what they say (it will take around a month for the notes to arrive). These notes will include more detailed information about the reasons for your refusal. When you apply again, you'll need to provide as much evidence as you can to overcome these refusals reasons.

Just to add to my above comment - you should be aware that even if you are able to get a new study permit and complete your studies, you should assume you won't qualify for a PGWP. (To qualify for a PGWP your studies must be continuous.)
