My application was refused and I received a five-year ban for not disclosing my US visa refusals. I misunderstood the question and thought it only applied to Canada. What should I do?

Did you reply to the letter? Usually you must respond to the letter in a certain amount of days. If not, you may want a lawyer to help but you need to respond and say that you made an error then list your US refusals. Your ban may be overturned but doesn’t mean you get an approved visa.

What type of visa? So you paid a lawyer to respond to PFL and were refused. You can try and take the government to court to appeal the ruling. It will cost a lot of money and you did misrepresent yourself, even if an error. IRCC was right and followed the law. An overturn doesn’t mean you will be approved for a visa. Only option is to wait 5 years.

An appeal is allowed…

  • if the decision being appealed was wrong in law or fact,
  • if there was a breach of a principle of natural justice (for example, a breach to the right to be heard or to be heard by an impartial person), or
  • in some cases, on the basis of humanitarian and compassionate considerations

Your options are the following:
1) Hire an immigration lawyer in Canada to try to overturn the appeal.
2) Wait out the five year ban before applying again to come to Canada.

Or, You can do things differently.

1. Travel to Singapore first. Establish a quick travel history.
2. Use this to Travel to New Zealand for a week.
3. Travel to Australia for a week.
4. Now apply U.S visa with a return ticket. But don't travel to U.S actually.Just get the visa stamped on your passport.
5. Apply Canada visa under CAN+ program. Have your visa done in 20 days.

You can do all this, after getting the BAN removed first.
