Why didn’t you apply for a visa originally for your son when you and your spouse came to Canada? More than likely your son is the family tie for you to go back when your visa is over

His entire family is in Canada so obviously they dont believe he is a genuine visitor.
A lawyer will not help reverse this decision, you can apply again if you can make his case stronger but it doesnt seem likely to be granted.

Budget for $5K for a judicial review as a start. It will only review if the VO decision made an error in law, not the circumstances for the refusal. Given you and your wife are here on WP, IRCC is probably concerned you won’t return to your home country when your permits expire. His family ties in Canada are stronger than his ties at home. It will be a tough decision to overturn.

actually when i applied for visa in india for both of us my and wife that time i did not have my son passport as well one more identity (adhar card) identification card of india. and whole system to apply for adhar card stop for long while on that time so i am helpless to get new passport for my son so thats why did not aplly for my son in application.

I would refile. I think there has been an error. Refiling would be much faster. Did you and your wife show enough savings to support your child? If so I would recommend filing for a TRV again and take the time to write an extra explanation letter explaining that you don’t know why your child was previously refused. He is currently living with your mother and you and your wife are currently working in Canada and can afford to take care of your child in Canada.

Hello, you can get a medical certificate from a doctor explaining your mother current health status and the urgent need to have the child reunited with the Parents. That might strengthen your case but honestly this is just a money making venture and getting a lawyer is not going grant approval. It is best to request the immigration file notes and write a letter of explanation addressing all the concern raised. Where possible provide supporting documents to substantiate your case.

You are suggesting he commit fraud. I would not encourage anyone to lie to immigration. Doing this could lead to a 5 year ban. This could also get your child refused if your child is thought to need expensive medical care in Canada. For both reason it would be very stupid thing to do.
