hi i would like to know if i can get son advice on my case am trying to bring my husband here we been marry for 4 years now he went for his interview and the officer refuse his case saying it not genuine what must i do cause this answer is hurting me so bad that i keep crying just thinking about it. just seeking some answers thank you :-[ :-[ :-[ :-[ :-[ :-[ :-[

Through what I experienced if the Immigration Officer thinks your marriage is not genuine than he is probably correct. Did they interview him? If they did you should get a copy of what was asked during the interview and how he replied. If they asked him simple questions and he couldn't answer maybe he doesn't genuinely love you and just using you. Better to go with your gut then to live with a bad gut like me after the fact. Because it will be hard to get any satisfying results if he has landed and he did use you for residence.

Not in all cases, sometimes vo has their minds made up simply from looking at ages. The vo in my husbands case did not put in her notes that he answer every question she ask of him, correctly. She lied when she said he didn't know where I worked, my family or what I do here in Canada. She say I don't work. I have a 20+ career! Different Religions does not concern him, we both believe in God. She took it as he's taking things too lightly. I've lived there 6 mos and the four other times at least a month. Like I said had her mind made up. If they video taped the interview than no chance for vo to make ppl look not genuine. We asked for English, she made her notes in French. An all around bag. There's other cases like mine if a person reads back in appeals thread.

Definitely order your GCMS notes to see what concerns the visa officer had, and to see what he or she wrote about the interview.

However, I do not believe that the visa officer is always right about whether a relationship is genuine. Some appeals are won, and the people go on to have a normal relationship. For example, at my appeal, my lawyer summed up the evidence by saying, 'Actually, you know, their answers were the same.'

Hi there,

You did the right thing to knock at this forum as most of the members here are ready to help you with information and support.

First of all, if your relationship is genuine then stop worrying and file appeal at IAD within 30 days from the date of refusal. Also please collect blue book on the case file which will contain comprehensive information. This blue book will arrive typically within 90 days. Please don't forget to collect GCMS notes on your husband's application file which will give you an idea why they refused. GCMS notes can be ordered online over CIC website by you at a cost of CAD 5/- and will be delivered to your email within 30 days

You have also a clear choice to apply again right from the scratch.

Meanwhile if you can afford, get a very good lawyer to defend you at IAD with all the documentation proofs. The most important thing is to prepare well for the interview at appeal. Most probably your husband couldn't prepare well before interview and couldn't explain everything properly.

Try for ADR (alternative dispute resolution) instead of full hearing. Go to appeal thread of this forum and you will learn many things.

If you want effective suggestions you may tell your story here to let the members know why the visa officer thinks the relationship is not genuine. Tell how you developed your relationship, how you married, how long you cohabited with your spouse, what are the red flags in your file etc.

Thanks I just see your respond and thank well from the start we didn't give them a lot of evidence to show our relationship and second he was here and over stay his time so now the immgarntion office think he just want to get back here so now they give was me a IRB hearing do you know the different between a IRB and a ARD
