Hello everyone,
I am on study permit in Montreal canada and I got married in August 2018. So i applied for my husband spouse open work permit on 2019-07-17 and it got rejected stating that Previous refusal for TRV noted.Proof of current enrollment as a fulltime student not provided.Letter from school is dated but only indicates that inviter was enrolled in the program and the start date was january 28,2019.No evidence for current enrollment for inviter.PA doesn't meet the requiremnts of Spousal OWP under section 205(c)(ii) . My husband never got refusal before.this is the first time he applied.but they also gave this stupid reason.What is this section and what are the documents now i needed to clear that rejection ? Please help.

Your husband is only eligible for an OWP while you are a student.

You didn't provide proof of current enrollment as as full time student aside from a letter from seven months before you applied, much less the summer or fall semesters of class.

You need to provide proof of current enrollment to get your husband an OWP.

He had previously applied for a tourist visa and was refused. They may suspect that he would not return to his home country after the OWP, or that with him in Canada, that you would not return.

Yeah.I didn't provide current enrollment. But he first time applied for visa so how could the find out the previous refusal and what documents should i need for section 205 c ii

You need to ask him about the previous TRV refusal as surely he knows about it.

205(c)(ii) is the clause in IRPA that allows spouses of study permit holders to get OWPs. You need to prove you are a current student for him to be eligible under that clause.

Did you previously apply for a TRV before getting a study permit? That sentence could apply to you. If it isn't you, your husband needs to tell you what happened or you need to order GCMS notes.

I also never got refusal.Thank you for your help

Just want to clarify that spouses of international students aren’t guaranteed a permit/visa although they can apply. Some are accepted and some are refused. Your husband may have applied for a visa a long time ago. You may want to ask his parents.

Yup....i will ask .Now my current enrollment letter will be enough for the requirement or do i need to provide my attendance data from college?
