Refusal of ICT Canada Visa

Hi,

I work foran IT company in India and I had applied ICT in June'2014. I got refusal letter on 28th July'14 with below reason.

" You have not demonstrated that you come within the exceptions under section 186 of the
Regulations exempting you from the requirement to obtain a work permit or that your
employment in Canada comes within the exceptions to section 203 of the Regulations. As a
result, your offer of employment must be the subject of an economic effect determination before
a work permit can be issued to you. Your employer in Canada should contact the local office of
Service Canada to begin this process."

Can anyone please tell me how to resolve this and how much time it is going to take to re-apply or re-submit.

CIC obviously don't consider that you comply with the strict requirements for an ICT.

Therefore, you will have to ask your employer to start the LMIA process in Canada. This will require that they show that there is no Canadian/PR that could be employed for this position. You cannot apply now until your employer has completed the LMIA application and received approval. This could be any time from 6 to 20 weeks. Then you will have to apply for a visa and work permit.

Depending on what specialist skills or training that you have, an LMIA approval may be hard to obtain.

there is many refusals on ICT applications as a result of CIC's resent changes to the ICT specialized knowledge category. my colleague who has applied on 16 june got refusal latter today.

Yeah in a quick recall, i think they have added things like "specialized knowledge of company's internal technologies that cannot be replaced in Canada, and specialized knowledge in the domain as well". My memory is a bit hazy, but earlier rules stated fewer requirement for ICT and new mandates have made that much more difficult.

Update:
May be gcms notes exactly mention which rule of ICT it does not comply with in case the OP is not sure of the reasons, and wish to understand the refusal further in order to reapply.
