Refusal London V/0 wrong points assessed after 18Months- Help Pls..

Dear Seniors and experts, Please help me out is there any way for reconsideration or appeal.

I sent my full documents to London-Visa Office on 18-October-2010. Since then my case is" In process". Yesterday I received a letter with only my original birth letter form London visa office stating that "I have now completed the assessment of your application for a permanent resident visa as a skilled worker and have determined that you do not meet the requirements for immigration to Canada". ... and so on.. its a detailed letter.

Your application was assessed based on the occupation in which you requested assessment NOC-2013 Computer and Information Systems Managers. The table below sets out

the points assessed for each of the selection criteria:

POINTS ASSESSED

AGE--------------------------------------- 10

EDUCATION------------------------------- 22
MUST BE--- 25

FIRST OFFICIAL LANGUAGE PROFICIENCY----10

SECOND OFFICIAL LANGUAGE PROFICIENCY--00 MUST BE----02

EXPERIENCE-------------------------------21

ARRANGED EMPLOYMENT-------------------00

ADAPTABILITY-----------------------------00

TOTAL-----63

The VISA officer give me less marks, According to my assessment and Centralize intake eligibility review it has to be.

1) Education: He give me only 22 points it must be 25 points. As I have done Masters with 17+ Years of full time education and my degrees are HEC recognized. In

addtion I am here in London-UK doing 2nd Masters as well and I have completed 1 semester and only 3 months to finish my degree.

2) SECOND OFFICIAL LANGUAGE PROFICIENCY: I have done 2 levels of French language certified course from ALLIANCE FRANCAISE (French Cultural Centre). To eligible for the

basic two (2) points one level is enough. However, I did Two (2) Levels But they didn't give me Two (2) basic points for second official language proficiency. I sent them my original certificate for French language

I would be very obliged for your advise is there any way to let them reconsider my case. What should I do?

Regards.

At my time this certificate was acceptable that’s why CIO(Centralize intake office) eligibility was completed and some of my friend did that course and CIC awarded them the basic French proficiency points which was mentioned in their COPR something like that. Also licensed immigration consultants were also advised me as well.

in that case write the letter to the VO explain ur situation with all supporting documents and valid points to them..........lets i pray for u

I year diploma is not counted, they calculated it right, its not a matter of making 17 years somehow.

My One year post graduate diploma is needed to eligible for master's track. With the base of One year diploma I am eligible for the MSc because the bachelors of commerce (BCom) is not the track of education as Bachelors of Computer Science (BCS) that why I did 1 Year diploma.

For the Second official language proficiency visa office should have grant me 02 points. because some of my friends got marks in their COPR for French language certificate from the same institute.

That was your requirement to do one year diploma, but if somebody is having BCS degree he doesnt need to do this diploma right? so in that case one year diploma will not be counted.

Well Its a one year Full time education for the same track as I have done B.COM as well which is my another education. Also in the Immigration guide it is mentioned that " Master's or PhD AND at least 17 years of full-time or full-time equivalent study ". Therefore, I am fulfilling the criteria, for Masters and at least 17 years of full-time studies.

For the Second language proficiency they must grant me basic 02 marks for French language course because I was Pre-June-2010 candidate at that time Test was not compulsory .

Please check this new release of 2010 , please check this link : http://imageshack.us/photo/my-images/855/newsrelease2010.jpg/

Immigration Guideline says " A maximum of 2 points can be awarded at the Basic proficiency level.
You should not submit your test results or written submission to the Centralized Intake Office (CIO) in Sydney, Nova Scotia Canada. If the application is recommended for further processing, the test results or written submission should be submitted to the responsible Visa Office."

Just to clarify, was the Masters in Computer Science a DEGREE or Diploma as that could make a difference. Good luck.

I just happened to come across this forum while searching for immigration advice, I am also pre-june 2010 applicant, and i believe that TEF was the accepted exam, but was not mandatory to claim points one could claim points on basis of a sample writing, or even DEALF A-1 or A-2 exam, after June 2010 it has become mandatory to submit TEF result to claim points in french.

one quick question while we are on the issue of education credentials, does LVO treat O and A levels as equal to 13 years of education or equal to 12 years of education.
