Refunding of Processing Fee if not in NOC !!

Can someone explain whether the following content written in CIC site means that if we apply and later CIC officer comes to know that our experience does not meet the revised NOC, our processing fee would be refunded. !!!


Is my application eligible for processing?
In order for your application to be eligible for processing, you must either:

have an offer of arranged employment, OR
be a foreign national who has been living legally in Canada for one year as a temporary foreign worker or an international student, OR
be a skilled worker who has had at least one year of experience* in one or more of the following occupations within the last ten years:
*Experience is defined as continuous full-time or equivalent part-time paid work experience

NOTE: the occupations above are all Skill Type 0 (managerial occupations) or Skill Level A (professional occupations) or B (technical occupations and skilled trades) on the Canadian National Occupational Classification list.

If you are not sure if you should apply as a skilled worker, you can use the eligibility tool to get an idea of whether your application would be eligible for processing.

Federal skilled worker applicants who do not meet the above criteria will be informed of this and will have their processing fee refunded.

Hi Rupesh,

when you say that "fees will be refunded if u do not fall under any noc". Are u saying that if profession does not fall under the current (29) preferred NOC? or the comprehensive NOC list itself?

I really hope if someone can help me with this as the last resort appears to be go down to the actual High Commission office in London to get a refund.

To explain briefly i have been a victim of the Feb 2008 NOC change which was officially published on Canadian website in NOV 2008 or rather the changes came to effect in November 2008

I applied in May 2008 and i received an acknowledgment letter in October 2008 giving me a File Number. Following that i received another letter from Canadian High Commission in DEC 2008 that my application is not Valid as i applied after Feb 2008 ( in my defense i am sure i did not read anything about the change on the website at the time).The letter clearly stated that my refund for the application fee will be sent within six month (approx 278 GBP/ 550 CAD) . I waited and did not get any refund June 2009. i moved and sent a change of address letter in August 2009 and reminded them about my refund to be sent to my new address. i sent few inquiries through online cic.gc.ca informing them of my change of address and chasing fee refund as i had no response for any of my letters. Usually when an email is sent through website, apparently you get a response within 28 days. i have waited quite a few (28 days) months and none of my letters or emails have been responded. I finally sent a strong letter in Nov 2009 (recorded delivery) which was signed for or received by Canadian High Commission on 10 Nov 2009 and still no response. i sent another email enquiry in July 2010 and absolutely no response.

What do i do?? the website clearly states that they do not accept enquiries in person but i am seriously considering to go down to office in london. Please help!!
