Yes, CBSA will pay for your flight ticket if you don't have the money. If you ever want to return to Canada in the future, you will need to repay the cost of this flight and also go through the ARC process (authorization to return to Canada).

In 2012 CBSA tried pilot program for repatriation allowance for failed claimant but the Auditors found it is not cost-effective and timely approach. I guess, due to the fact that it costs $15,000 for escorted removal, $1,500 non-escorted. Some EU country do, but Program was killed during pilot stage in Canada.

We are family of four persons in Canada.
I came in canada on Feb 2019 and my wife with 2 kids joined me July 2019. We all visited canada on Multiple Entry visitor visa. We filled Refugee Claim at Montreal in Aug 2020 and got Acknowledgment of Claim. Passport seizure in Mar 2021 at Montreal IRCC. We are waiting for Eligibility Interview (Referral interview). No referral to IRB yet. We applied for work permit in Jan 2021. My wife only received Work permit in Oct 2021 without our eligibility interview (i presume it is approval to work as she cannot work unless we do our eligibility interview and get id’s). But my family member at back home is very sick at our back home country and we have to go back home country immediately and no option but to forego our refugee claim. We have been on social assistance from Nov2020 till now for survival.
We are very much stressed, can you please help us by answering following questions :
1. How to proceed /apply for refugee claim withdrawal and where and whom to contact for withdrawal?
2. What are likely negative part on our future plans to visit again to canada (work permit/visitor visa/Study Permit/express Entry) ?
3. When shall we get back our seized Passports to visit our country by plane?
4. Would we be liable to return social assistance we have been getting for survival which was used for survival in waiting for work permit ?
5. Any other things which we should reconsidered as consequences on/after withdrawal?
Please help us as me, my wife and kids are very stressed to go back to home country under unavoidable situation.

2-if you want to come back to Canada you will need to go through the ARC process (authorization to return to Canada)

3. At Point of Exit. you will make arrangement with CBSA and they will handover your passports at the airport

1. Claim is at the Refugee Protection Division not IRCC(Immigration Division). There is legal form to fill and send to RPD.

Hi Simba, thanks for reply. But are you sure our claim is with IRB and not with IRCC ? Because I understand that IRB is not into picture unless you are referred to IRB (after eligibility interview with IRCC is done) . In our case we have not yet invited for eligibility interview by IRCC yet ?

Hi Sohaib, thanks for information. But I am not able to get Refugee Claim Withdrawal Form on website. I think that should be the IMM 5317B. Am I correct ? I am searching that form on ircc website but did not get. Can you guide me further ?

The moment you declare you are refugee claimant, you are referred to IRB. Provided you made submission, IRB comes into the picture...Waiting for eligibility interview does not mean you are not a refugee claimant, and the IRCC can not remove you from Canada until your determination, you abandon and or you withdraw your claim. Withdrawing claim is IRB. I can understand where your confusion is but you may confirm with your counsel.

The Notice of Withdrawal of a Claim for Refugee Protection (PDF, 280 KB) should be submitted to the Refugee Protection Division (RPD) if a claimant is withdrawing their claim for refugee protection under Rule 59(2) of the Refugee Protection Division Rules.

This form can be printed and completed by hand, or it can be completed electronically and printed. Signatures cannot be entered electronically; you must first print the document and sign by hand.

The completed form should be submitted to your regional RPD office by mail, fax, or in person. It cannot be submitted by email.
