Hello everyone
I have 2 situations right now and I’m looking for any comments to take the best decision

1 I’m a refugee claimant (Nov/2107) my case was denied past June (2019) and probably my appeal process gonna be the same, I’m still waiting
I started a relationship with my girlfriend August 2018, she’s a international student and she’s going to get her post graduate permit probably in January

the question is there’s any chance she can sponsor me with her work permit or i need to wait until she apply for the PR??
What’s gonna happen if my appeal is denied in the following months?
There’s any other process can help me to stay in Canada??

Hi - you likely have a "conditional" removal order and the condition is that if you are found to be a Convention refugee it then disappears. If you are not a refugee then you become the "subject" of an enforceable removal order.

In other words, you will become a client of the CBSA who will look to execute the removal order.

So, that you are hoping to once again have some sort of status in Canada isn't likely to happen because you took your shot at the refugee process and it failed.

It is a serious matter to make a claim to Convention refugee status but it only gets serious after the claim is unsuccessful. If your appeal doesn't work then you're no longer a refugee claimant but instead are on a list for removal.

As far as waiting for her PR, what does your girlfriend's status in Canada have to do with your lack of status? The answer is, nothing.

Simply as a matter of interest to other failed claimants who fall in love as their status in Canada is revoked, the timing of the relationship is always looked upon suspiciously - always. So any new love that is found may have to be realized outside of Canada. Love wins out even if immigration to Canada doesn't.

Having a girlfriend in Canada won't be of any help at this time. It will only potentially help at the point where she is applying for PR.

My second problem is:

As I said my refugee claimant was denied and I’m in the appealing process, my family is coming to visit me in December, do you think they can be rejected at the airport because of my status?

It is very surprising that they got a visa to begin with. Did they have a visa before you claimed asylum?

All of us have US visa, we used to travel a lot to visit family, they just applied for the ETA a few months ago

Oh you are from a visa e pet country. That made your chances of getting asylum very low. Yes certainly your asylum claim could cause issues for your family. It is hard to say if they will have problems entering Canada. If anything they may receive notice that their ETAs have been cancelled.

since your common law has no PR status, the outcome is uncertain. Yes she can apply for your open work permit together with her PGWP, but that might or might not be approved.
Given that you have a failed refugee claim, what is your status in Canada? Because appeal itself does not give you any status.

As for your family. Yes they can be denied entry and turned back just because of your failed refugee claim.
So they need to be ready for that.
There is even a chance that their ETA could have already been cancelled.
