Hi,

My PR cards expired last year and I was not able to return to Canada. Can I claim refugee status since my home country is in war and I live out of it?

I doubt it very much until you renounce your existing PR status. You will need to apply for a Travel Document to come back to Canada or try the USA/Canada land border route.

You would need to officially give up your PR status first.

Next, you would have to be officially recognized as a refugee by UNHCR or a similar referral application.

Thank you very much. This makes a lot of sense. I did not meet the minimum stay requirement hence can not apply for a travel document. I had to leave to take care of my mum. Will this be considered a humanitarian ground and will they revoke my PR status should they reject my application ?
 
If you have proof that you had to remain outside of Canada to take care of your mother, then you should try to apply for a PRTD requesting H&C consideration.
