My mistake. So just to be clear, has your refugee claim in Canada already been refused and the appeal rejected as well?

Yes my claim refused ,I appealed and it was also refused

Then it's time to move to a higher court..Federal court. Don't give up..keep going up and up in court hierarchy

Apply immediately for Humanitarian and compassionate grounds because having kids gives you the right to apply without having to wait 12 months.

Was your appeal refused by the IRB or federal court?

Thank you . My appeal was refused by IRB.
My kids are 2,4&6years old do you think they will consider that

Than youk .my kids are 2,4&6 years old . Do you think they will consider that ? Is it strong case to be reviewd as humanitarian case?

First of all, appeal your decision at the federal court and do it as soon as possible given that you have 30 days to file the appeal.
Meanwhile prepare a Humanitarian application with all the information ready to file it. The only thing im not sure about is if you can apply before receiving the decision from the high court or not.

And yes given your kids age and circumstances, you have a chance.

since they rejected it from the appeal will be difficult , i have been through all that since 4 yrs back and fourth from Federal court and IRB. However , try your chance with H&C because you have kids they will consider it.

I really wish you a good luck.

Hi I m also refugee and my case is rejected I m applying Appel but some reason I fee Appel also will reject and lawyers asking so much money witch I don’t have I want to know after how many years I can apply for humanitarian base .i m single no kids .if any one have good knowledge please advise me

- You cannot make a h&c claim if you don't have minor child.
- You can generally apply for H&C after 1 year.
- You must have a lawyer represent you and you should find a good one.
Please read this:

The OP's case is a classic anchor baby case. They had 3 kids in US while they were unsure about their fate which probably ended up in family being separated. The other day someone said this in forum about giving birth in Canada as a refugee to "strengthen ties", which is absolutely garbage advice as the emotional toll this can have is tremendous. These routes can buy you tine, but at the end, if you don't have a valid claim, you will be sent home sooner or later.
But I really need protection .
