Refugee/Asylum seekers from Hong Kong

Hi everyone.

Situation in Hong Kong is exacerbating. Over the past months, there has been constant protests and assemblies pertaining to citizens' requests to the government of Hong Kong and China. Police force is deployed almost everywhere in Hong Kong. They have been applying excessive, unnecessary and unlawful force to the peaceful protesters and pedestrians, which include but are not limited to teargas, pepper-spray and shotguns. Recently, gangsters have been indiscriminately beating up protesters, and even random people, with weapons such as batons, knifes, and that they are evidently suspected to be affiliated to certain politicians in town.

It is taking place almost everyday. The government, the police force and triads have been creating white terror in the city. Even students studying abroad who return to Hong Kong by air are questioned why they are landing in Hong Kong, "are you back to support the protests?" they would ask. A soon-to-marry couple are charged riots just because they helped a protester pushed to fall by the police.

All these aforementioned incidents are merely a tip of an iceberg. No one can guarantee what will happen in the foreseeable future. People are risking their lives to live in the city.

I am now studying in Canada on study permit. It frightens and horrifies me, if I would ever return to Hong Kong, that I would face unnecessary mental and physical pain because of my political stance in line with the majority of the protesters, as well as that I have actively participated in a series of social movements in the past as I grew up.

Based on my personal circumstance, would it be likely to be approved if I applied for protection from within Canada? Some of my friends - actively participating in the protests - are interested as well. Let's discuss and share your views.

Extremely low chance of approval at this point. Especially give you haven't been personally / directly impacted in any way.

IRCC will say this situation hasn't been going for very long at this point and may very well be temporary (i.e. will likely dissipate) - so there are insufficient grounds to meet asylum requirements at this time. If this situation goes on for a long time with many arrests, etc. - this could of course change.

For the time being, I would focus on your studies and obtaining a PGWP.

Sadly, there’re updates on the current situation.

There’s evidence, if not that it’s proven, that certain Chinese Police personnel infiltrated into and disguised in HK police force in recent operations.

The police force shot tear gas and rubber bullets in an underground(metro) station, which is an indoor environment. Lots of random passengers are innocently injuries. One injured woman has been shot in her right-eye. She bled so much that it’d be unlikely that her vision would not be damaged.

Moreover, the police had shot numerous shots of tg at a senatorium. Dozens of senior citizens’ lives were at risk. They didn’t give a fick. Every time they shot harmful substances are bullets to citizens, they would hinder medics from helping and saving the injured. It’s a blatant violation to humanity, and it shall be deemed a war crime.

If Chinese forces do have infiltrated into HK police, the special status of HK would right away cease to exist.

Not sure why you would want to make a refugee claim when you have a better chance at becoming PR through what you are doing now (study and PGWP).

If you are asking for other people, they need to be personally impacted. Consult a lawyer before taking a step in this direction.

Key word being “they” not “i” (meaning you). If the they you are referring to are who are thinking of filing a claim, do they have a TRV to come to Canada? If so, they may fly in and file their claim. If they don’t, then step 1 is to get a TRV or move to another country and register with UNHCR.

My spouse’s friends from the Philippines just went to Hong Kong (they got back a week ago) and they said there were certain areas affected but not all of Hong Kong. This is from their story so I am not a reliable source. Canada will have an eye on the situation of course because there are Canadians living in Hong Kong or on a vacation there. So no matter what happens, Canada will know the whole situation which may or may not help the asylum claim of any person who says they have been personally affected.

If you are a leader of the protests or have been arrested you can try and apply for asylum. If you have not been personally targeted and are just a face in the crowd or not protesting you don’t have proof that you are personally being persecuted.
