Hello,
IRB denied, RAD denied on appeal. I'm applying for judicial review at federal. Can I pursue PNP in BC from inside Canada while judicial review application is pending?
Another question. Why is PRRA after one year of denial? Don't the enforce removal after RAD denial?

I'll help with one question. Unfortunately applying for PNP is not an option since you have an unresolved refugee claim. This makes you ineligible to apply.

I will answer the second question, PRRA is a safety net that looks at risks that may arise between the period of a negative refugee decision and removal from Canada. If there is no removal within that period of time then there can be a PRRA review to see what risks may have arisen.

If they can remove you within this period then the original CR refusal is viewed as the assessment of negative risk for you to be returned to your country. In other words, PRRA is for people where removal is imminent and the negative CR decision is viewed as "stale."

PRRA approval rates are below 5% usually, but I haven't seen actual statistics for sometime.

Thank you scylla. I spoke to my lawyer earlier and he said he is not sure what exactly they mean by "unresolved". My claim was denied by IRB and RAD and I haven't appealed for Judicial Review yet. Don't you think where I stand currently it has already been resolved? Decision has been made.
Please tell me how can I take advantage of BC PNP where I clearly qualify and also can get a job offer letter from a major employer here within weeks if not days.
Please advice.

The only way you can qualify for BC PNP is to leave Canada and apply outland. You CANNOT apply inland as you have no status in Canada.

This is exactly what I was trying to avoid - going out of the country. I guess there is no way then.

My question is,, Can my common law sponsor me I have been with her more than 1 year she is Canadian? While judicial review application is pending? My worry not been deported back home,Thanks.

Your problem is, that you do not have a legal status in Canada. That is why any PN or EE application or even one for Quebec is out of question.
One condition for all 3 of them if you are in Canada is to have a legal status during the whole staying in Canada while your application is running. However they you specify it more properly in their conditions.
