My care giver to be in Philippines just recieved VISA/ approval on March 20, 2009 but original LMO will expire on May 16, 2009.
Can she use this LMO to enter Canada, start working while a new LMO is under process?

If she arrives prior to 16/05/09 she will be fine, otherwise get the LMO extended.

When she gets to port of entry (toronto) how many days/months Imiggration will gave her a work permit? Until May 16, 2009?
What evidence she will bring with her showing that the LMO has been processed? What is the risk of denied entry with TRV and having only 5 weeks left of LMO v.s. a new LMO upon entry?

You are confusing apples with oranges, if the LMO is valid when she arrives, and let say the LMO for the job is for 2 years, she will get a work permit for 2 years, not the time that the LMO is valid.

LMO was approved 5/16/2006 with Opinion Expiry date 05/16/2009. My caregiver is from Philippines and when I got the LMO 3 years ago, it took that many years to get VISA appoved... Now she has the VISA but the LMO is almost expiring. F.Y.I.: Duration of Employment in the LMO is only 12 months. The wage approved at that time is $8/hours.

What you are trying to say as long as she applied for work permit before the Opinion Expiry Date (5-16-2009) at the port of entry (when she lands at Toronto), she will be given a work permit up to 12 Months (Duration of Employment in the LMO) and not work permit until 5-16-2009 only?

Will there be an issue regarding the Wage in the LMO?[/u] I know that the new Ontario Povincial Minimum Wage for Caregive will be $10/hr... I'm actually sending her a new contract with the new regulated wage.

I'm new to this forum... just want to know how you know these things...
Are you a lawyer? Do you work for an agency? Work for CIC? Hope I'm not offending you on your knowledge in the subject...

1. She will given a one year work permit, just ensure that she a copy of the contract with the new wage level.

Do I need to buy her a round trip ticket since only 12 months duration of employment in the LMO?
So, there is no need for me to apply for an LMO if she can land prior to the expiry date?

1. No need for RT ticket.
2. No need for extension of LMO if she arrives before it expires.
