Hi guys, im so worried now because i received a letter from Cic regarding our application. Im not even sure how to start. CIc is asking a lot of things:

1. Submit a statutiry declarion of common law union.
2. Complete Imm5669 schedule A background declaration form.
3.police certificate and medical exam


One thing im so worried is that they are requesting sufficient evidence that we are common law cohabiting 1 year while in fact i already sent the lease agreement we have from the previous places we rented since 2010 until present. Im not sure if they lost that or should i call them and tell them or write a letter stating that i already sent it with the application. One thing is they are requesting for divorce paper but my partner was never divorce because his exwife doesnt want to sign the papers.

Please help me..im so desperate now...

If a lease is all the evidence that you sent, I'm not surprised that CIC isn't happy. A lease doesn't prove that you are common-law; it could even be argued that it doesn't really prove that you both lived there, as one of you could have simply signed it while living somewhere else. You needed to send things like mail sent to that address in both names and individually, joint bank statements/credits cards, joint utilities, e-tickets/hotel reservations/matching passport stamps, letters from family and friends, insurance policies naming each other etc. You need to prove a genuine common-law relationship and just a lease doesn't do that.

Have your partner write a letter explaining that he has attempted to get a divorce but his wife isn't co-operating and he will be going through the courts to get the divorce. When you take the Statutory Declaration of Common-Law Union to be notarized, have the notary public notarize your partner's letter as well.

There is no need to be desperate, just do what they have said. Get the police certificate, do the medical, send the requested documents.

Thank u for your response canuck..we have included the insurance showing him as my beneficiary in insurance,letter from the bank when we open our joint account,ticket from our travel when we visited my parents, letter from his employer saying that im included in his medical and life insurance and some letters and tons of picture..so im not sure what to send anymore...we also included our emails when we first met to show how our relationship started. I was planning to write a letter explaining this.

I guess the divorce certificate i cant do anything, maybe ur right i just have to go have him write a letter and have it notarized..

Any other inputs?

It doesn't sound like they are requesting you to send more physical proof of the relationship, they are requesting you send them a Statutory Declaration of Common Law Union. Is there more to the request then you have stated? This is form IM5409. It is a declaration of your common-law relationship and just asks that you declare what proof you have and then have it notarized. This form is not technically required for a regular common-law sponsorship but is sometimes requested.

What you're listing is just proof that your relationship is genuine, not proof of cohabitation. You need to send them bills, letters, statements, any correspondence that shows that you had the same address for at least the last 12 months. The lease is not enough, because, just like canuck_in_uk wrote, someone can sign the lease but physically reside and get his/her mail somewhere else.

Agreed. You need to send more proof of cohabitation.

Thanx betina, but like i said i have sent them the letter address to us when we opened our joint bank account,same address also when our insurance agent sent us the confirmation of him as my beneficiary, bills address to our address. I thought u have to prove that u live for a year plus evidence that we are in a relationship is enough, im not sure what they want because thats all got and thats what we sent them...

May I ask why? Have you read the application package requirements before sending it out? Because it seems to me that might be your main problem.

I'm pretty sure that you don't have to send medicals with an inland application, because they will for sure expire before the application is processed. Probably it's the same with the PCC.

Did you declare yourselves common-law with the CRA?

Yes we declare it in the cra as well..and the assesment from 2010-2012 shows my name as the commonlaw partner...and our address shows there too...like i said i sent everythng that will prove our 1 year cohabitation and proof of genuine relationship..im not sure if the VO overlooked it because it was a total of 6 envelope and i have them all labeled and has caption...

Your input guys are very much appreciated..we dont want to hire a lawyer just for this too because i know they will rip us off...

I agree with betina.its not necessary to have ur medical together with the application..i also confirm this with cic befre i sent the package...

From what information you have given us, I think they don't have a problem with your relationship and the statutory declaration is just standard.

The complete Schedule A is beginning to become standard, also. I was also asked to give a complete one, even if I've sent them the one for the last 10 years.

As for de medical and police documents, that could be a good sign - they could be ready to advance your file in the next stage of processing.

My advice would be not to freak yourself out and just send them the documents :D And hope for the best ;)
